WHEREAS, Chapter 380.06 Florida Statutes"Florida Land and Water Environmental Management Act" requires local government to establish a date certain, and give public notice, for a local public hearing on an Application for Development Approval for. a Development of Regional Impact prior to is- suing a Development Order; and WHEREAS, by letter of March 25, 1980, the South Florida Regional Planning Council has notified the City of Miami that the Application for Development Approval has been scheduled for the Council meeting of May 5, 1980 and that a local public hearing could be scheduled for the Watson Island Develop. -rent, a Development of Regional Impact, located on Watson Island and bay bottom in Biscayne Bay. WHEREAS, Chapter 330.06 Florida statutes requires local government to set a public hearing date at its next regularly scheduled meeting after the receipt of such a letter and to give at least sixty (60) days notice of the hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing shall be held on June 26, 1980, at 7:30 p.m. in the City Commission Chambers, City Hall, 3500 Pan American Drive, Miami, Florida 33133, con- cerning issuance of a Development Order for the Watson Island Development, a Development of Regional Impact, located on Watson Island and bay bottom in Biscayne Bay. Q ,;.. ._ of Regional Impact It is requested that the Commission establish June 26, 1980 as the date for the Development of Regional Im- pact public hearing for the Watson Island development, per the attached Resolution. Per Chapter 380.06 F.S. local government is required to give notice and hold a public hearing on an Application for Devel- opment Approval (ADA) for a Development of Regional Impact prior to issuing a development order. By letter of March 25, 1.980 (attached) the South Florida Re- gional Planninq Council has stated that the Watson Island ADA will be scheduled for the Council meeting of. May 5, 1980. Further, the letter stated that the Development of Regional Impact public hearing must be set at the next regularly - scheduled meeting of the Commission and advertised at least sixty days in advance of the hearing, per Chapter 380.06. F.S. It is requested that the Commission consider the setting of the hearing date at their meeting of April. 10, 1980 and establish June 26, 1980 as the Development of Regional Impact public hearing date for the Watson Island development, which would allow for the required sixty-day notice. This public hearing does not constrain the City to a certain construction schedule; the Commission, if it issues a Develop- ment Order approving the project, can appropriately condition time of commencement. Eerre, Mayor City of Miami 3500 Pan American Drive Miami, Florida 33133 Dear Mayor Ferre: This letter is to give written notice that although the Watson Island Application for Development Approval does not contain sufficient information for regional impact review, due to the City of Miami's refusal to provide the information requested in our letters of November 9, 1979 and h"arch 18, 1980, we will proceed with the Development of Regional Impact review on the proposed Watson Island development. A Development of Regional Impact public hearing as required by Chapter 380.06(7), Florida Statutes amended, must be set at your next scheduled meeting and advertised at least sixty (60) days in advance of the hearing. The law also requires that the notice of public heariric be tra-,Smitted to the Division of Local Resource Mlanaa_cment and the South Florida Regional Planning Council. Receipt of this notice will officially commence our fifty day review period. At this time, the South Florida Regional Plannin, Council staff report and recommendations are tenta- tively scheduled to be presented for official action at the regular Council meeting on May 5, 1980.
