as an arterial in accordance with criteria contained in Section 334.03
Florida Statutes; and

sification purposes on April 5, 1978; and
WHEn:,;S, in conformance with s tntutes, this road is scheduled to be
added to the State Highway System and transferred to St:tte jurisdictional
responsibility; and
in conformance with statutes a right-of-way plat of subjort
Road has been prepared and is attached for F)roper execution after which
s!id plat will be duly recorded in the Public Records of Dade County by
the State;

Department of Public Works for proper execution be given to the State for

The State of Florida Department of Tramsportation, after a public hearing
held on April 5, 197�, functionally clakisifi::d as an arterial, in accordance
with Florida Statutes, a portion of Bird Avenue within the Cori orate limits
of the City of :ULari.
Since th,-� City of Iiiami hau previously acquired certain right-of-way parcels
alon's S.!1. 40th at. (Bird Avenue) between (U.j.1) St,- to Road 5 and S.W. 39th
Ave., We have been requested to trariz;fer all intcrcjt thereof to the State.

(Transfers of Right -of -Way)
Dear Mr. Cather:
In response to your letter of March 3, 1980 to Mr. S.L. Fuller regarding
the preparation of the Right -of -'Way Map for that portion of S.W. 40 Street
(Bird Road) which lies within the Miami City Limits and is being transferred
into the Florida State Highway System, please be advised that the map is
totally acceptable. We would appreciate it if you would forward the original
executed mylar to our office together with a copy of the Resolution accepting
this transfer. This would give us an opportunity to make additional mylars
for our filing system and take care of the recording of the neaps in compliance
with Section 337.29.
Should you or any member of your staff have any additional questions, please
don't hesitate to call this office.

Reference is made to your letter of October 29, 1979, to Mayor Ferre,
regarding a portion of Bird Ave. ( j.W. 40th St.), being transferred
to the State highway Syotem.
Attached is a print of the prorosed Hight -of -way Map prepared by
this department for your review. This is in conformance with
instructions received from reprecontativos of the State.
If you concur with the plat an is, wo will proceed to have it
executed by the proper city officials before formal exception by the

The above listed road was functionally classified as an arterial in ac-
cordance with criteria contained in Section 334.03 Florida Statutes.
This facility and others was subjected to a public hearing for classifica-
tion purposes on April 5, 1973.
Accordingly, in conformance with statutes, this road is scheduled to be
added to the State Hic;:h�.iay System and transferred to State jurisdictional
responsibility on or about Nov.-rnber 29, 1979.
