The bidder agrees to start work within ten (10) con-
secutive calendar days after date of written notice from the City
Manager to begin work. The work may be started on anv working; dad►

1. DEFINITIONS
The purpose of this Division is to provide coverage for
all conditions applicable to this Contract., where such cover-
age is not provided for in other portions of the Contract
Documents.
' In case of any conflict with the provisions of other
portions of the Contract Documents, the provisions of this
Division shall prevail, unless amended by addenda issued
subsequent to the publication of these Contract Documents.
2. SCOPE A14D DESCRIPTION
Tile work to be performed under this contract consists of
furnishing all labor and equipment necessary to remove abandon
vehicles in the City of Miami., as directed by the Director of
the Solid Waste Department. Vehicles shall include but may
not be limited to automobiles, trucks, house trailers, small
boats, etc.
3. LOCATION AND DESCRIPTIONS
The Enforcement Division of the Solid Waste Department
will furnish to the contractor a list containing the following
information:
1. location of vehicle '
2. description including year of manufacture if decernable
3. color
4. I.D. number (if available)

4. PERFORMANCE
Contractor shall remove vehicles promptly after receiving
written notice, generally within 10 days. The City reserves
the right to rescind pickup orders at any time prior to the
actual picking up of the vehicle.
LIMITATION OF OPERATIONS
No pickup shall be made on Sunday or any day between the
hours of 10:00'P.M. and 7:00 A.M. unless written permission
is received from the Director of Solid Waste.
6. INSURANCE
The contractor shall maintain during the terms of this
Contract the following insurance:
.01 Public Liability Insurance - on Comprehensive basis,
including Contingent Liability, in amounts not less
than $300,000.00 per occurrence for bodily injury,
and $50,000.00 per occurrence for property damage.
.02 Automobile Liability Insurance - covering all owned,
non -owner and hired vehicles used in connection with
the work, in amounts not less than $100,000.00 per
person and $300,000.00 per occurrence for bodily

;\IN✓ The insurance coverage required shall include those

classifications, as listed in standard Liability Insurance
Manuals, which most nearly reflect the operations of the
Contractor.
All insurance policies shall be issued in companies
authorized to do business under the laws of the State of

Florida.
The Contractor shall furnish certificates of insurance
to the City prior to the commencement of operations, which
certificates shall clearly indicate that the Contractor
has obtained insurance in the type, amount and classifica-
tions as required for strict compliance with this Article
and that no material change or cancellation of the insurance
shall be effective without thirty days prior written notice
to the City.
Compliance with the foregoing; requirements shall not
relieve the Contractor of its liability and obligations
under this Paragraph of under any other portion of this
Contract.
i. PAVIENT BY CITY.
All payments for work performed shall be of the unit price
bid for Item la of the Proposal.
Payment shall be made on the first of each month based on
a list submitted by the Contractor and verified by the Enforce-
ment Division of the Department of Solid Waste.
BY CONTRACTOR
If contractor bids unit price per vehicle he shall remit
monthly an amount equal to the unit price bid times the number
of units collected. The number of units collected shall be
verified by the Enforcement Division prior to acceptance of
any monies.
8. CONTRACT PERIOD
Contract shall be inf.orce from the date of award through

December 31, 1980. Contract: may be extended for a period of
one year upon the mutual agreement of the City and the Contractor.
9. CONTRACT CANCELLATION
j Contract may be cancelled by the City for cause after
providing the contractor written notice of its intention to do
so. Contractor shall receive at least a seven calendar day
notice of the City's intention.
10. STORAGE
I
The Contractor is not required to store any vehicle
certified for pickup under this Contract unless written
authorization is received from the Director of Solid Waste.

Attached is .n copy of a letter from County Mnnap,er
Stierheim advising that Dade County will. not provide
disposal service to the municipalities until the lawsuit
is resolved. It is my understanding that the suit in
question involves the City of Opa Locka, Florida and
,Dade County.
I have spoken with Rill Hampton of t-he Cotinty Minager's

Attached is a copy of a letter from County Manager
Stierheim advising that Dade County will not provide
disposal service to the municipalities until the lawsuit
is resolved. It is my understanding that the suit in
question involves the City of Opa Locka, Florida and
Dade County.
I have spoken with Bill Hampton of the County Manager's
office and was informed that the County would not allow
any municipalities to use their contract unless said
municipality would adopt an ordinance which conforms
with the County ordinance. However, he could not assure
me that the County_ would not again discontinue this
service.
Based on the current contract that Dade County has, a
contractor is removing abandoned property for the salvage
value with no direct cost of the County.
Therefore, I am recompending that the City enter into a
similar agreement of lt_is, own to ensure that there is no
disruption in our ability to provide this service to our
citizens.
A proposed agreement similar to that of Dade County's is
attached for your consideration.
