HomeMy WebLinkAboutO-09088EHK/slm 3/12/80 2bD ORDINANCE Nb. 9 0 8 8 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8835 ADOPTED JULY 279 1978, WHICH ESTABLISHED A TRUST AND AGENCY FUND ENTITLED: "POLICE SECOND DOLLAR TRAINING"; BY INCREASING THE APPROPRIATION FOR SAID FUND IN THE AMOUNT OF $62,953, FROM REVENUE RECEIVED FROM DADE COUNTY FOR FISCAL YEAR 1978-79 PURSUANT TO FLORIDA STATUTES, CHAPTER 943.25(5); AND MAKING APPROPRIATIONS THEREFROM FOR THE PURPOSE OF PROVIDING LAW ENFORCEMENT TRAINING AND EDUCATION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, Ordinance No. 8835, adopted July 27, 1978, established a Trust and Agency Fund entitled: "Police Second Dollar Training" to receive funds for the purpose of providing law enforcement training and education; and WHEREAS, Florida Statutes, Chapter 943.25(3) authorizes the assessment of one dollar ($1.00) as an additional court cost against every person convicted for violation of a state penal or criminal statute or convicted for violation of a municipal or county ordinance, and also $1.00 from every bond estreature or forfeited bail bond related to such penal statutes or penal ordinances and for payment for such funds into the State Treasury; and WHEREAS, Florida Statutes, Chapter 943.25(5) permits municipalities and counties to assess an additional $1.00 as aforesaid, for law enforcement officers; and WHEREAS, Dade County Resolution No. 103-75 (Section 1) authorizes the aforesaid assessments to be "earmarked specifically for law enforcement training and educational purposes;" and WHEREAS, Dade County Resolution No. 103-75 (Section 2) provides for such funds to be credited on a pro-rata basis by the number of authorized sworn officers in duly authorized law enforcement agencies in Dade County at the commencement of each County budget year; and WHEREAS, Dade County Resolution No. 103-75 (Section 3) resolves that a mutually agreeable plan for the efficient distribution of such funds among the affected law enforcement agencies be established by the County Manager or his duly authorized representative; and �V WHEREAS, revenues totalling $62,953 were received from Dade County for fiscal year 1978-79 and are available to be appropriated into the "Police Second Dollar Training" Trust and Agency Fund; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF HIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 8835, adopted July 27, 1978 which established a Trust and Agency Fund entitled: "Police Second Dollar Training" is hereby amended in the following particulars:V "Section 1. The following Trust and Agency Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Police Second Dollar Training RESOURCES: $1.00 additional assessment of court costs per State Statute 943.25 (3 and 5) 1) Received from Dade Count FY 6-7 and 7- 8 $132,650 2) Received from Dade County FY 78-79 $ 62,953 TOTAL RESOURCES: $195,603 APPROPRIATION: $3,32s66® $195,603" Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance dre hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. 1/ Words and/or figures stricken through shall be deleted. Grassie City Manager Manohar S. ,urana, Acting Director Departmen lanagement and Budget March 28, 1980 Appropriation of Police Second Dollar Revenues from Dade County Ordinance No. 8835, adopted July 27, 1978, established a Trust and Agency Fund entitled: "Police Second Dollar Training" to receive revenues generated from the assessment of one dollar ($1.00) authorized by Florida Statutes, Chapter 943.25 (3) and (5) against every person convicted for violation of a state penal or criminal statute, a municipal or county ordinance, and from every bond estreature or forfeited bail bond related to such penal statutes or penal ordinances. The distribution of these monies is provided for in Dade County Resolution No. 103-75 on a pro-rata basis by the number of sworn officers in authorized law enforcement agencies in Dade County at the commencement of each County budget year. These assessments are earmarked specifically for law enforcement training and educational purposes. The attached proposed ordinance increases the appropriation for the above mentioned Trust and Agency Fund by $62,953 to reflect revenues received from Dade County for FY '79 pursuant to Florida Statutes 943.25 (5). This ordinance has been prepared for the April 10, 1980 City Commission meeting. slm/2bJ
