HomeMy WebLinkAboutR-80-0310�9 RESOLUTION NO. 80-'310 A RESOLUTION REAFFIRMING THE TERMS OF RESOLUTION NO. 79-521, AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WITH THE STATE OF FLORIDA DEPART- MENT OF TRANSPORTATION TO FORMALIZE AN EASEMENT FOR THE CONSTRUCTION OF THE CONNECTING LINK BETWEEN THE CONVENTION CENTER AND THE CONVENTION CENTER GARAGE; TO GRANT TO THE STATE DEPARTMENT OF' TRANSPORTATION AIR RIGHTS FOR THE CONSTRUCTION OF A FUTURE RAMP TO SERVE THE DUPONT PLAZA AREA, WHICH AIR RICAITS MAY PASS OVER A PORTION 01' S.E. 4TH STREL'T AND OVER PROPERTY IDENTIFIED AS THE PATRICIA HOTEL SITE; AND FURTHER AGREEING THAT THE CITY WOULD BE RESPONSIBLE FOR ANY ADDITIONAL COSTS POR THE FUTURE CONSTRUCTION OF THESE RAMPS IN BOTH THE EASEMENTS GRANTED TO THE CITY AND THE EASEMENT GRANTED BY THE CITY TO THE STATE. WHEREAS, the terms and conditions of Resolution No. 79-521 are reaffirmed; and WHEREAS, the City will receive from the State an easement for the construction of the escalator building and pedestrian connection between the Convention Center and the Convention Center garage; and WHEREAS, the State will receive from the City the rights to use the air space over S.E. 4th Street and over the former Patricia Hotel site; and WHEREAS, the City has agreed to assume any future additional costs in conjunction with the future construction of the bifurcated ramps; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is authroized to formalize the conditions established by Resolution No. 79-521. Section 2. The City Manager is authorized to execute the attached agreement between the City of Miami and the State Department of Transportation, which conditions are made a formal part hereof. FAUN= ......................... . r AGREEMENT Ject' 1 87006-2501 Miami dxpressway (Downtown Distributor) of BETWEEN STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION THIS AGREEMENT made and entered into this day , 19 , by and between the City of Miami, Florida, hereinafter referred to as The City and State of Florida Department of Transportation, hereinafter referred to as Department. WHEREAS, The City intends to construct a convention center as generally depicted in Exhibit "A" and, WHEREAS, the center is to be partially constructed on properties owned by the Department and said properties are on the Federal -Aid System of Highways of the U. S. Department of Transportation, Federal Highway Admistration (FHWA); and WHEREAS, the Department contemplates extending SR 854 (Downtown Distributor) by constructing a Bifurcated Ramp, and in doing so will need to utilize some land which is presently owned by the City and generally referred to as Patricia Hotel Propertys NOW THEREFORE, in consideration of the covenants, promises, understandings and Agreements made by each party to the other as set forth herein, the parties hereto do mutually agree as follows: I THE DEPARTMENT will by quitclaim deed transfer title to The City the land described in Exhibit "B" for the purpose of partially relocating S.E. Fourth Street to accommodate convention center traffic, subject to FHWA concurrence. ��SUPPO � i tvr_ DOCU A�'I E (% II FOLLOW THE DEPARTMENT, subject to FHWA concurrence, in accordance with the provisions of Volume 7, Chapter 4, Section 3, of the Federal -Aid Highway Program Manual, will grant to the City an Air - Space Lease to the property described in Exhibits "CI" & "CII" for the purpose of constructing an enclosed Pedestrian Underpass and for the purpose of erecting an Escalator ("CII"). Page 1 of 3 " 80-31 0 III THE CITY will grant to the Department Air Rights to the Patricia Hotel Property as described,in Exhibit "D" for the purpose of con- structing a Bifurcated Ramp with a provision that when the pier locations are determined the City will, upon written request by the Department, convey title to these areas. The City will retain the right to Landscape and Beautify this property until required for the ramp and subsequent to ramp construction. IV The Department and The City agree that in the event that the air rights provisions of Section III are not exercised by the Depart- ment within twenty years from the date of this agreement, then Section III of this agreement shall become void. V THE CITY will pay any and all additional construction costs for the Bifurcated Ramp.incurred as a result of the relocation of S.E. Fourth Street wherein FHWA determines that it will be Non Federal -Aid Participating. The City may have the option of realigning a portion of S.E. Fourth Street to reduce or eliminate any Non Federal -Aid Participating Cost. VI THE CITY, in accordance with Resolution No. 75-547, in exchange for the property described in Exhibit "B" will convey to the Depart- ment its interest in property that was utilized for the construction of the Homestead Extension (Parcel No. 127.1 - 87005-2311 - SR 821) described in Exhibit "F".
