HomeMy WebLinkAboutO-09095} LCD/slm AMENDMENT NO. 14 TO ORDINANCE NO. 9000 ORDINANCE NO. 9 95 AN ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1980, AS AMENDED; BY INCREASING THE APPROPRIATION FOR THE GENERAL FUND, DEPARTMENT OF PLANNING AND ZONING BOARDS ADMINISTRATION, BY $30,959; INCREASING GENERAL FUND REVENUES, NON -REVENUES, BY THE SAME AMOUNT FROM THE FY'79 FUND BALANCE; FOR THE PURPOSE OF PAYING ACE -PARKER, INC. FOR THE PRINTING AND MAILING OF ZONING HEARING NOTICES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ;1N TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9000 on October 17, 1979, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1980; and WHEREAS, Resolution No. 79-664, adopted September 27, 1979, authorized the acceptance of a bid from Ace -Parker, Inc. in the amount of $30,959 for the printing and mailing of zoning hearing notices associated with the new proposed Comprehensive Zoning Ordinance; and WHEREAS, funds available in the Fiscal Year 1979 Budget for this purpose were not encumbered as required and, therefore, lapsed into the FY'79 Fund Balance; and WHEREAS, funds are not available in the Department of Planning and Zoning Boards Adm. -nistration's current budget to pay for said services; and WHEREAS, the Department of Planning and Zoning Boards Administra- tion is requesting an appropriation of $30,959 to cover the aforementioned services; and WHEREAS, funds are available from the FY'79 Fund Balance and can be appropriated into the General Fund, Department of Planning and Zoning Boards Administration, for the aforementioned printing and mailing services; tJOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF h1IM1I , FLORIDA: -Section 1. Sections 1 and 5 of Ordinance No. 9000, adopted October 17, 1979, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1980, as amended, are hereby further amended in the following particulars:l/ "Section 1. The herein appropriation of $30,959 into the General Fund, Department of Planning and Zoning Boards Administration, and the cori responding increase in General Fund Revenues, Non-Revenues, FY'79 Fund Balance, is for the purpose of paying Ace-Parker, Inc. for the printing and mailing of zoning hearing notices. Section 3. Ail ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provis- ions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four-fifths of members of the Commission. As required by the Local Government Comprehensive Planning Act of the State of Florida (Ch. 163.3161 et seq., Florida Statutes), the Miami City Commission on May 12, 1971, adopted the Miami Comprehensive Neighborhood Plan, which sets out future land use locations and development policies. Under the Local Government Comprehensive Planning Act the City's zoning ordinance must be in conformity with the Neighborhood Plan. The present City zoning ordinance, originally adopted in 1961,and amended innumerable times since, is not adequate to meet Miami's changed and changing conditions and does not conform to the Neighborhood Plan. A proposed new zoning ordinance has been drafted, and substantial revision of the present C-3, Central Business District, Classification is currently under way as a separate process and as a related part of the new zoning ordinance.
