Attached is a request from Bryant,'Miller & Olive, our bond counsel, on the
Watson Island project for a -partial payment of their fees for assisting the
City with activities concerning Watson:.:Island beyond those contained in their
contract for legal services dated March 31, 1978.
While there is no formal amendment.to the:contract which provides for the,..
additional services which.Bryant, Miller & Olive has performed, there:is'some.
justification -in my mind for the .reimbursementfor-these. services Several .
key issues arose which would have prevented the Watson. Isl and project from.
going to market had.it.not been.for the efforts of Bryant;.Miller & Oli-ve
with the State Cabinet` -on three.critical issues. First, it took nearly
six ,months for us to'achieve: .Cabi.net,acti6n,on the .waiver'of the deed restriction
which.prevents us from leasing any.portion`of Watson Island.; Bryant, Miller.. &
Olive during this period. of time made numerous contacts with`the agencies;
inv61ve'd'including__DNR, DER and,each of the Cabinet members:and -their aides..:.
They represented`Us before the Cabinet and Cabinet,aides`meetings'as welI,as..
with various, legal''staffs in the departments involved. It`was with. their .
leadership, and guidance that we were able to achieve a compromise position
with the Cabinet that permitted the Cabinet to -waive -the deed.restriction"for
the'lease'of Watson- Island.. second; Bryant, Mi1'ler'&:Olive worked with us in:
Tallahassee,on the issue of the aquatic preserve rules A's you know,_a:signi-
ficant`number of lobbying groups were opposed`to any:exceptions:from the aquatic
preservIes. and.were, in'fact, pushing.very..di1igently wi,th.each Iof,;the. Cabi.net-
members for inclusion of.,.all upland portions of ,public property;:to be'covered
by,'he aquatic preserve rules.'.:Had.the rules been inacted;to include Watson
Island,` it. is, -.highly, Uhlikely_that Watson,.Island'could:have-been started or
that,bonds could.have been.taken`to- 'market until a:considerable amount of
litigation. had been pursued,to finally remove.upland portions -from the aquatic
preserve. Third 'Bryant,.Miller & Olive represented the City. before the adminis-
tration Board in re -moving' -the 771/2 percent.limitation on bonds. While this>_was
not a major effort on their.part, they -did function in',this:capaciay and;it is
beyond the scope of services described in their. contract... In addition,:Bryant;
Miller &..Olive played a. significant r-le.in.assisting the ..City with;A ts.litiga-
tion,over:the suit filed by adjacent property owners.; They also, through
negotiations with the State Attorneys office,,prevented_�an`appeal on:;the..bond
validation'question which.would.`have resulted - in protracted litigation,-'had:the
opponents.to__Watson Island.been able to, enter.the.validation proceedings.after
they had been completed.. Finally,' the firm of Bryant, Miller &'Olive:represented
the Gity on numerous occasions in dealing with the'Department of Housing and
Urban Development, the White House and various administration officials in
