A modification of the requirements as set forth in Section 3 (4) (b) of the City of Miami Charter, Chapter 10847, Special Acts, Laws of Florida, 1925, as amended, to permit construction of a Planned Area Development (PAD) residential project (LA SANTA MARIA) on Lots 47, 48, 49 and 50, Block B; MARY & WILLIAM BRICKELL "DOCUMENT INDEX ITEM N0. KORNER, who after first by me being duly sworn, deposes and says the following: 1. I was the chief zoning inspector with the City of Miami until my resignation from that position in 1966. 2. During that time it was my responsibility to inter - pert the City of Miami Zoning Code. 3. The City of Miami Zoning Ordinance 6871 was past and adopted June 2, 1961. 4. The City of Miami Zoning Code was interperted and applied uniformly though out the City of Miami to permit the use of underwater land to be included in computation for lot area and therefore in computations for floor area ratio and lot coverage and density. 5. The definitions contained in the Miami Zoning Code require that the word "land" shall include water surfaces and land under water. 6. The interpertation permited the underwater area of lots to be included in Miami River sites, Little Ritter sites and Biscayne Bay sites. 7. The Muse Isle site located about Northwest 25 Avenue and the Miami River permitted the area out to the bulkhead line to be included in the computations for a proposed apartment complex. 8. The same interpertation was used in the construction of Biscayne 21 Apartment Building and that area was later filled. 9. The building located at Northeast 39 Street and Biscayne Bay is constructed using bay bottom property for lot area, said bay bottom later having been filled. 10. Jul.i.o ':,randa 8�-334 Ferre-Tract Plan Is Bad Bargain THE Toronto -based developers who contracted. to buy the Maurice Ferre family's old Brickell Avenue home, "La Santa Maria," have more than a beautiful mansion and a prime piece of bayfront land. They also seem to have carte blanche to do exactly as they please with the property, irrespective of zoning codes, density rules, or the Miami City Charter. Of course. the mayor insists that he has nothing to do with the eagerness of city officials and boards to rule in favor of permitting a 38-story condominium that would span 93 per cent of the lot's width. Mayor Ferre says he will abstain when the matter comes before the com- mission. Good. And the other four com- A Numbers Game WHETHER It is good news,or not :depends, we suppose, on the point of view. The, news is that the U.S. Jus- tice Department managed to get con- victions of 284 corrupt Federal and local officials during 1979. If one thinks official corruption is bad, then this is bad news. However, while we think corruption is indeed bad, the news is good because, 1979 'saw 10 more convictions than 1978, which is better because, we figure. about the same level of corruption is .going on all the time so when a few more are caught, why, that's good news. Of course, not as good as in 1977, when there were 296 convictions, which is 12 more than last year. To get a firm fix on the signifi- cance of all this, we think we'll just have to wait. What is the public ben- efit in allowing the massive cogdOmini- um tower on the Ferre property? Supposedly, the fitte old mansion is going to be preserved. That's nice. But only if the house is covenanted to be a public facility could it qualify' as a trade-off for exemption under the char- ter restrictions. Such a negotiated bene- fit would have to be spelled out in public meetings and approved by the commis- sion itself. Unless public access to the property is guaranteed. community asso- ciations would seem to have strong grounds for a suit challenging the ez- emptioh.
