AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE
NO. 9019, ADOPTED NOVEMBER 8, 1979, THE
CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE
FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1980,
AS AMENDED, BY AMENDING XII. B. TO ESTABLISH
FUNDING IN THE A14OUNT OF $30,000 FROM THE PARK-
ING CAPITAL PROJECTS FUND, RETAINED EARNINGS,
FOR FEASIBILITY AND DESIGN STUDIES FOR PARKING
STRUCTURES IN THE OMNI; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE, AND DIS-
PENSING WITH THE REQUIREMENT OF READING SAME
ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS
THAN FOUR FIFTHS OF THE MEMBERS OF THIS COM-
MISSION.
WHEREAS, the City Commission adopted Ordinance No. 9019
on November 8, 1979, establishing resources and appropriations
for the implementation of capital improvements in the City of
Miami, Florida for the fiscal year ending September 30, 1980; and
WHEREAS, the City of Miami is undergoing a considerable
anount of economic redevelopment in the vicinity of Omni which
increases the need for public parking; and
WHEREAS, it is in the best interests of the City to
determine the public need for intercept parking for the advent
of mass transit in the vicinity of the Omni; and
WHEREAS, the City Commission adopted Resolution 80-49
on January 24, 1980, stating its intent to acquire professional
services for the design and construction of parking structures
in the near future;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance 9019, adopted
November 8, 1979, as amended, is hereby further amended in the
following particulars:I/
"Section 1. The following appropriations
hereby made by fund and project title include
previously authorized projects and fund
appropriations for implementation of all municipal
capital improvements of the City of Miami, Florida.
The sources of revenue to support the herein
appropriations are hereby identified by fund

Section 2. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

proposed. The remaining provisions are now in effect and
remain unchanged. Asterisks indicate omitted and unchanged
material. All figures are rounded to the next hundred

2/ These studies are to be conducted under the supervision of
the Off -Street Parking Authority.

Se--tion 4. The requirement of reading this ordinance
on two (2) separate days is hereby dispensed with by a vote
of not less than four fifths of the members of the City commission.

Proposed Ordinance Amending_
Section 1 of Ordinance No. 9019
for Parking Structures
Feasibility Studies
It is recommended that the pro2oosed Ordinance be
adopted by the City Commission in its meeting of
May 22, 1980. The proposed Ordinance amends
Section 1 of Ordinance No. 9019, adopted November 8,
1979, as amended, by amending paragraph XII B to
establish funding in the amount of $30,000 for
feasibility and design studies for parking structures
in the Omni area; containing a repealer provision and
severa_bility clause; and dispensing with the
requirement of reading same on two separate days.
In the City Commission Meeting of April 24, 1980, the City Commission
adopted Ordinance No. 9093, which, among other things, established a
Parking Capital Projects Fund in the amount of $30,000 for
feasibility and design studies for parking structures in the Downtown
Government Center.
In confirmation with the policy established by the City Commission,
the City has identified the Omni area, bounded by the MacArthur
Causeway to the south, NE 2 Avenue to the west, NE 18 Street to the
north and Biscayne Bay to the east, as having the potential for the
construction of a multi -level, public parking structure. The
proposed Ordinance will provide funds to study the potential and to
determine the public need and economic feasibility of such a project.
It is pointed out that the Omni area has experienced considerable
redevelopment in the recent past and appears to be headed for
further redevelopment because of the Omni complex as a generator.
_ In addition, mass transit plans, including the construction of a
terminal of the Downtown People Mover, traffic congestion especially
in and around the MacArthur, Biscayne Boulevard exchange, all point
to the timely investigation of constructing an interceptor
multi -level, public parking structure in the area.
