O 3 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9019, ADOPTED NOVEMBER 8, 1979, THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1980, AS AMENDED, BY INCREASING THE FUNDING FOR VI. B. 4. AFRICAN SQUARE PARK BY $40,000 AND DECREASING VI. B. 21. REMAINING PARKS FOR PEOPLE DISTRICT III IMPROVEMENTS (7060) IN THE SAME AMOUNT; BY TRANS- FERRING VI. B. 5. TACOLCY-12TH AVENUE PARKS (7048) TO THE CAPITAL IMPROVEMENT FUND, CONTINUED PROJECTS, ESTABLISHING X. B. (i) 5. IN THE AMOUNT OF $9,700; BY DECREASING X.C. (ii). 6. ELIZABETH VIRRICK GYM RENOVATIONS (9015) BY $19,700; AND BY DECREASING X. A. FLORIDA POWER AND LIGHT FRANCHISE EARNINGS BY $10,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, The City Commission adopted Ordinance No. 9019 on November 8, 1979, establishing resources and appropriations for the implementation of capital improvements in the City of Miami for the fiscal year ending September 30, 1980; and WHEREAS, the City of Miami Department of Parks has determined that there is a need to make construction modifications to African Square Park with an estimated cost of $40,000; and WHEREAS, there are sufficient funds in the Remaining Parks for People District III Improvements Fund (7048) to support the increased appropriation for African Square Park; and WHEREAS, the City of Miami Department of Public Works has determined that it is necessary to replace the roof at the Tacolcy Center in Tacolcy Park; and WHEREAS, Resolution No. , adopted 11 authorizes the expenditure of $9,700 for the above mentioned roof repairs; and WHEREAS, an amount of $9,700 is available for said roofing project from the previous appropriation of $100,000 for the Elizabeth Virrick Gym Renova- tions (9015) because the cost estimate for the Virrick 3ym Renovations has been revised downward to $80,300; and WHEREAS, the Florida Power and Light Franchise Earnings in the Capital Improvement Fund will be reduced by $10,000, inasmuch as these funds will not be required for the Elizabeth Virrick Gym Renovations; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: in section 1. Section 1 of Ordinance No. 9019, adopted November 8, 1979, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The following appropriations hereby made by fund and project title include previously authorized projects and fund appropriations for implementation of all municipal capital improve- ments of the City of Miami, Florida. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. "It is recommended that Ordinance 9019, the Capital Improvement Appropriations Ordinance, be further amended for the purpose of establishing funds for construction modifications to African Square Park and replacement of the roof at the Belafonte Tacolcy Center in Tacolcy Park, as per the attached ordinance." The City of Miami's Department of Parks has determined the need for making certain construction modifications to African Square Park which will improve the delivery and enjoyment of recreational opportunities by the community. These modifications include additional park equipment such as a flagpole and gates, the enlargement of existing planters, and various construction modifications to place the wading pool in service and improve the function- ing of the amphitheatre facility. The improvements are being recommended by the Department based upon consultation with the local community and the Community Relations Board, and are estimated to cost $40,000. Funding is from the Remaining Parks for People District III Improvements Fund (7048). The City of Miami's Department of Public Works has determined that it is necessary to replace the roof at the Belafonte Tacolcy Center located in Tacolcy Park. The Department of Public Works prepared a resolution for award of bid of this work, which is estimated to cost $9,700. The project is to be funded from a previous appropriation of $100,000 from Florida Power and Light Franchise Earnings for the Elizabeth Virrick Gym Renovations (9015) in that the cost estimate for the Virrick Gym Renovations has been revised downward from $100,000 to $80,300. The Florida Power and Light Franchise Earnings in the Capital Improvement Program will also be reduced by $10,000 in light of the revised estimate of Gym Renovations.
