HomeMy WebLinkAboutO-09101LCD/pvg AMENDMENT NO. 17 TO ORDINANCE NO. 9000 5/15/80 ORDINANCE NO. . ? 0 3 .4 AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 9000 ADOPTED OCTOBER 17, 1979, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30,1980, AS AMENDED; (A) BY INCREASING GENERAL FUND REVENUES, NON-REVENUES,IN THE AMOUNT OF $633,107 FROM THE FY '79 CARRYOVER FUND BALANCE; FOR THE PURPOSE OF PROVIDING FUNDS TO OFFSET A SHORTFALL IN ANTICIPATED REVENUES FROM PROPERTY TAXES IN THE AMOUNT OF $451,997 AND FROM FIRE CODE INSPECTION FEES IN THE AMOUNT OF $181,110; (B) BY DECREASING GENERAL FUND REVENUES, NON -REVENUES FY 179 FEDERAL REVENUE SHARING FUND BALANCE, IN THE AMOUNT OF $78,450 AND INCREASING GENERAL FUND REVENUES, INTERGOVERNMENTAL REVENUES, FEDERAL REVENUE SHARING, IN THE SAME AMOUNT; FOR THE PURPOSE OF PROVIDING SUBSTITUTE FUNDING FOR THE OPERATION OF AFRICAN SQUARE PARK AS AUTHORIZED BY ORDINANCE 9098, ADOPTED MAY 8, 1980; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9000 on October 17, 1979, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1980; and WHEREAS, said ordinance anticipated revenues from Taxes in the amount of $67,559,818, which included the amount of $42,179,807 for Property Tax Revenues, and revenues from Charges for Services in the amount of $5,527,119, which included Fire Code Inspection Fees in the amount of $200,000; and WHEREAS, the final tax roll for 1979, received from Dade County, indicates a revenue shortfall of $451,997 in anticipated Property Tax Revenues; and WHEREAS, no revenues can be anticipated from Fire Code Inspection Fees, as this fee was not implemented; and WHEREAS, an amount of $633,107 is available from fiscal year 1979 Retained Earnings of which $451,997 can be utilized to offset the shortfall in Property Tax Revenues and the remaining amount of $181,110 can be used to offset the shortfall in Fire Code Inspection Fees;,and WHEREAS, Ordinance No. 9098, adopted on May 8, 1980, provided an amount of $78,450 from the FY '79 Federal Revenue Sharing Fund Balance for the operation of African Square Park for the period May 8, 1980 to September T 3, 1980; and E2 WHEREAS, it is now deemed necessary to change the source of funds for said operation to anticipated Intergovernmental Revenues, Federal Revenue Sharing, for FY '80; and WHEREAS, an additional amount of $78,450 can be anticipated from Federal Revenue Sharing funds in the current fiscal year; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 5 of Ordinance No. 9000 adopted October 17, 1979, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1980, as amended, is hereby further amended in the following particulars:-f "Section 5. The herein increase of General Fund Revenues, Non -Revenues, in the amount of $633,107 from the FY '79 carryover fund balance is for the purpose of providing funds to offset a shortfall in anticipated revenues from Property Taxes in the amount of $451,997 and Fire Code Inspection Fees in the amount of $181,110. Section 2b. The herein decrease of General Fund Revenues, Non -Revenues, FY '79 Federal Revenue Sharing Fund Balance, in the amount of $78,450 and the corresponding increase in General Fund Revenues, Intergovernmental Revenues, Federal Revenue Sharing is for the purpose of providing substitute funding for the operation of African Square Park as authorized by Ordinance No. 9098, adopted May 8, 1980. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Surana Shortfalls Acting Director E:FiCRENCES (b) Change of Funding Source Department of Mana ment and Budget for African Square Park _,;coo=_ne It is recommended that (a) $633,107 should be uti- lized from the FY '79 Carryover Fund Balance to offset a shortfall in anticipated revenues from Property Taxes in the amount of $451,997 and Fire Code Inspection Fees in the amount of $181,110; and that (b) funding for the operation of African Square Park should be provided from additional anticipated FY '80 Federal Revenue Sharing funds instead of the FY '79 Federal Revenue Fund Balance as authorized by Ordinance No. 9098. (a) The FY '80 Adopted Budget included anticipated Property Tax Revenues in the amount of $42,179,807. This estimate was based on the preliminary assessment of the 1978 taxable value received from Dade County in June, 1979. The final tax roll for 1978 has now been received and reveals that the City should anticipate $41,727,810 from Property Taxes, a reduction of $451,997 from the Adopted Budget. The FY '80 Adopted Budget also included $200,000 in anticipated revenue from Fire Code Inspection Fees. This amount should not continue to be anticipated as the fees were not implemented. Funds to offset this shortfall in revenues can be utilized from the FY '79 Fund Balance which is shown at $664,066 in the preliminary FY '79 Financial Statement. The distribution of this amount would be as follows: Fund Balance per Financial Statement $ 664,066 Less: Appropriated by Ordinance 9095 for the printing and mailing of zoning hearing notices 30,959 Current Available Balance Less: Required for Property Tax Shortfall To offset Fire Code Inspection Fees shortfall sc/L9.20 633,107 (451,997) M Grassie Page 2 (b) On May 8, 1980, the City Commission adopted Ordinance 9098 which ap- proved funding for the operation of African Square Park for the period May 8, 1980, to September 30, 1980, from the FY '79 Federal Revenue Sharing Fund Balance. Inasmuch as funds will not be available from this source, it is necessary to provide substitute funding. This can be done from additional Federal Revenue Sharing funds in FY '80.
