HomeMy WebLinkAboutR-80-0388■ /1 RESOLUTION 8 0- 3 8 8 A RESOLUTION ACCEPTING THE BID OF SOUTHERN TURF NURSERIES FOR FURNISHING GREENS REPAIRS AT THE MIAMI SPRINGS GOLF COURSE FOR THE DEPARTMENT OF LEISURE SERVICES; AT A TOTAL COST OF $49,875.00; ALLOCATING FUNDS FROM THE 1979-80 CAPITAL IMPROVEMENT FUND OF THAT DEPARTMENT; AUTHORIZING THE CITY ,TANAGER TO EXECUTE A CONTRACT FOR THIS SERVICE IN ACCORDANCE WITH THE AGREEMENT ATTACHED HERETO. WHEREAS, pursuant to public notice, sealed bids were received April 8, 1980 for the furnishing of Greens Repairs at the Miami Springs Golf Course for the Department of Leisure Services; and WHEREAS, invitations were mailed to 7 potential suppliers and 1 bid was received; and WHEREAS, funds for this purchase are available in the 1979-80 Capital Improvement Fund; and WHEREAS, this service will be used by the Department of Leisure Services for the purpose of redesign, drainage, and appearance of the golf course greens; and WHEREAS, the City Manager and the Department of Leisure Services recommend that the bid received from Southern Turf Nurseries be accepted as the most ad- vantageous bid to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The April 8, 1980 bid of Southern Turf Nurseries for furnishing greens repairs at the Miami Springs Golf Course for the Department of Leisure Services at a total cost of $49,875.00 is hereby accepted with funds hereby allocated from the 1979-80 Capital Improvement Fund, when funds are available. Section 2. That the City Manager is hereby authorized to execute a con- tract for this service in accordance with the agreement attached hereto. PASSED AND ADOPTED this 22 day of May , 1980. Grassie City Manager • t AGREEMENT ■ This Agreement, made and entered into this day of , 1980, by and between the City of Miami, a municipal Corporation of the State of Florida hereinafter referred to as the "CITY", and Southern Turf Nurseries, a State of Georgia Corporation, Licensed in the State of Florida, hereinafter referred to as the "CONTRACTOR". NOW, THEREFORE, in consideration of the covenants and affirmations as herein set forth, the parties mutually agree as follows: General The CITY hereby engages the CONTRACTOR for the redesign and renovation of greens #1-10, of the City of Miami Country Club, 650 Curtiss Parkway, Miami Springs, Florida 33166. Scope of Work The design and renovating of said greens shall conform to the specifications as described in Attachment "A" and to include but not limited to,the following: 1. The removal of approximately three !3) feet of sand mix from green #7 for disbursement to other greens as needed. 2. Each of the ten (10) greens shall require the approval of the City (i.e. the Director of Leisure Services, Director of Parks, and the Golf Course Superintendent), as to the design and renovation, drainage, etc., prior to grassing of. same. 3. The CONTRACTOR will make reasonable changes as requested by the City subsequent to approval, prior to grassing. 4. The CONTRACTOR will permit the presence of a landscape architect from the Parks Design Division, for any assistance required. The grassing of said greens shall conform to the specifications as described in Attachment "B". Compensation For Services The amount of compensation to be paid ti►e CONTRACTOR shall he Forty -Nine Thousand Eight Hundred Seventy Five Dollars ($49,875.00). Said amount shall constitute full compensation to he paid the CON'fRACTUR fur the services a*atPri /1 herein. The compensation shall be paid in accordance with the following con- ditions: 1) 30% partial payment upon execution of the contract. 2) 40% payment upon completion of redesign and renovation prior to grassing. 3) 30% upon completion of grassing and final approval by the City. Time of Performance This contract shall become effective upon execution, and the services of the CONTRACTOR are to commence as soon as practicable after execution and shall be undertaken and completed in light of the purpose of this contract; but in any event all services required hereunder shall he completed by Personnel insurance All personnel of. the CONTRACTOR shall be covered by Workmen's Compensation, unemployment compensation and liability insurance; a copy of said insurance policies and appropriately executed certificate of insurance, shall be furnished to the City Clerk of the City of Miami. Hold Harmless The CONTRACTOR assumes all risk in the operation under this Agreement and shall be solely responsible and answerable in damages for accidents or injuries to persons or property, whether direct or indirect, arising out of the operations under this Agreement, or arising by virtue of the carelessness, negligence or improper conduct of the contractor or any servant, agent or employee of the CONTRACTOR, and hereby covenants and agrees to indemnify, defend and save harm— less the CITY its officers and employees from every such claim, suit, loss, dam— ages, or injury. Termination of Agreement If the CONTRACTOR shall fail to fulfill in the proper time and manner its obligations under the CONTRACTOR, the CITY shall have the right to terminate this contract by giving written notice to the CONTRACTOR of such termination and specifying the effective date of such termination. In that event, the CONTRACTOR — shall be entitled to receive just and equitable compensation for any satisfactory work completed prior to terminating. However, the CONTRACTOR shall return the balance of the advanced funds to the CITY that the CITY determines the CONTRACTOR is not entitled to. 2 80-388 Non —Discrimination CONTRACTOR agrees that there will be no discrimination against any employee or person served on account of race, color, sex, religious creed, ancestry, or national origin in its performance of this Agreement; and it is expressly under— stood that upon receipt of evidence of such discrimination, the CITY shall have the right to terminate this Agreement. After our office approved a routine type Resolution accepting a bid for the above project, we were asked to approve a proposed specific contract implementing the bid. Our review of the contract revealed that some major changes were necessary; accordingly, we redrafted the agreement and have prepared another resolution, both of which are attached hereto.
