WHEREAS, the City of Miami Zoning Board in its meeting
of April 7, 1980, Item No. 3(b), following an advertised hearing,
adopted Resolution No. ?B 55-80 by a 6 to 0 vote, denying a variance
as hereinafter set forth; and
1,jHEREAS, the applicant has taken its appeal to the
City Commission, and
VTHEREAS, notwithstanding the denial of. the Zoning Board,
the City Commission, after careful consideration and dine deliberation
of this matter, has determined that the variance requested meets all
the City's requirements for said use;
1101 THEREFORE, BE IT RESOLVED BY THE. COMMISSIOM OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The req-uest for a variance from Ordinance
No. 6871, Article VIII, Section 3(2) (c) and 3(3) (a), to permit
construction of an office building for the United [lay of Dade County
on Lots 11 thru 15 less 1,110' of Lot 11 for right-of-wav; Block 70;
VIAMI (B-41) , bein;* 955 Southwest Second Avenue, as "er site *plan on
file, with 39' north side vard (40' recuired), and 30' rear yard
(40' regt:ired) be and the same is hereby granted.
PASSED AND ADOPTED this 6 day of June , 1980.

REQUEST (a) Conditional use to permit a philanthropic
and eleemosynary organization (The United
Way of Dade County) to operate on above site,
as per site plan on file. This application
in conjunction with a variance petition for
side and rear yards.
and
(b) Variance to permit construction of an office
building for the United Way of Dade County on
above site, as per site plan on file, with
20' north side yard (40' required) .and 20'
rear yard (40' required). This application
in conjunction with a Conditional use
petition.
RECOMMENDATION (a) DEFERRAL UNTIL AN ACCEPTABLE SITE PLAN IS SUBMITTED.
PLANNING DEPART- The proposed use will only be acceptable if develop-
MENT ment plans which meet the zoning regulations
are proferred.
(b) DENIAL. There is no hardship which justifies
granting these variances. There are several
options for development of this site:
The existing building could be removed
before the new structure is built; a portion
of the existing building could be torn down
to permit adequate setbacks for the new
structure; the lot immediately to the east
could be purchased and included in this site;
or a portion of the existing building might
be reused in the new development. A final
option would be to develop on another site
altogether.
Twenty -foot setbacks would be harmful to the adjacent
properties since this would permit a 5-story (65')
wall only 20' from the property line. Inadequate
air, light and open space would be available to
adjacent properties.
