ORDINANCE NO. 9 1 1 1
AN ORDINANCE AMENDING SECTIONS 2 AND 5 OF
ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE
ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL
YEAR ENDING SEPTEMBER 30, 1980, AS AMENDED; BY
INCREASING THE APPROPRIATION FOR INTERNAL SERVICE
FUNDS, BUILDING AND VEHICLE MAINTENANCE, HEAVY
EQUIPMENT MAINTENANCE, BY $60,000; BY INCREASING
REVENUES FOR THE INTERNAL SERVICE FUNDS, BUILDING
AND VEHICLE MAINTENANCE, HEAVY EQUIPMENT
MAINTENANCE, BY THE SAME AMOUNT FROM THE BUILDING
AND VEHICLE MAINTENANCE DEPARTMENT, HEAVY
EQUIPMENT MAINTENANCE DIVISION, RETAINED EARNINGS
FOR THE PURPOSE OF PROVIDING ADDITIONAL FUNDS FOR
HEAVY EQUIPMENT PURCHASES; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND
DISPENSING WITH THE REQUIREMENT OF READING SAME ON
TWO SEPARATE DAYS BY VOTE OF NOT LESS THAN
FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9000 on October
17, 1979, establishing revenues and appropriations for the City of Miami,
Florida, for the fiscal year ending September 30, 1980; and
WHEREAS, Ordinance No. 9061 appropriated an amount of $400,000 into
the Internal Service Funds from the Heavy Equipment Maintenance Division,
FY'79 Retained Earnings; and
WHEREAS, said amount was transferred to the Capital Improvement
Fund to purchase office furnishings for the New City Administration Building;
and
WHEREAS, Ordinance No. 9094 substituted the funding for the
aforementioned furnishings from Florida Power and Light Franchise fees; and
WHEREAS, the Department of Building and Vehicle Maintenance is
requesting an amount of $460,000 to fund heavy equipment purchases for FY'80;
and
WHEREAS, inasmuch as $400,000 is available due to the aforemen-
tioned substitution, an additional $60,000 is needed to fund said purchases;
and
WHEREAS, an amount of $60,000 is available from FY'79 Retained
Earnings of the Heavy Equipment Maintenance Division and can be appropriated
into the Building and Vehicle Maintenance Department, Heavy Equipment
Maintenance Division, for the aforementioned purchases;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OE' t"t CITY OF
MIAMI, FLORIDA:
Section 1. Sections 2 and 5 of Ordinance No. 9000, adopted
October 17, 197% the Annual Appropriations Ordinance for the fiscal year
ending September 30, 1980, are hereby amended in the following particulars:l/
"Section 2. The following activities, which are
carried on for the service and convenience of
other funds, shall be operated by the City Manager
within the limits of the appropriations provided
in the foregoing Departments, Boards, Offices, and
accounts of the City of Miami and other revenues
or receipts which may be received:

Section 5. The above appropriations are based on
the following sources of revenues for the 1979-80
fiscal year:

Section 2. The herein appropriation of $60,000 into the Internal
Service Funds, Building and Vehicle Maintenance, Heavy Equipment Maintenance
Division, and the corresponding increase in revenues for the same division is
for the purpose of providing additional funds for the purchase of heavy equip-
ment for FY'80.

Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining provi-
sions of this ordinance shall not be affected.
Section 5. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than four -fifths
of the members of the Commission.

Legislation to Increase
Appropriation for the Internal
Service Funds to Purchase Heavy
Equipment
The Department of Building and Vehicle Maintenance is requesting
the appropriation of $460,000 to fund the purchase of heavy
equipment for fiscal year 1980. Resolution No. 80-313 accepted
the bids and authorized the issuance of purchase orders.
It should be noted that Ordinance No. 9061 appropriated an amount
of $400,000 into the Internal Service Funds from the Heavy
Equipment Maintenance Division, FY ' 79 Retained Earnings. This
amount was transferred to the Capital Improvement Fund to pur-
chase office furnishings for the New City Administration
Building.
Ordinance No. 9094 substituted the funding for the purchase of
the furnishings from Florida Power and Light Franchise fees.
Therefore, the funds appopriated by Ordinance No. 9061 are
available for the equipment purchase.
Inasmuch as $400,000 is already available, an additional
appropriation of $60,000 is needed to fund the purchases. This
amount is available from FY '79 Retained Earnings of the Heavy
Equipment Maintenance Division and can be appropriated.
The attached proposed ordinance has been prepared for the June 6,
1980. City Commission Meeting.
