HomeMy WebLinkAboutO-09107AMENDMENT NO. 53 TO ORDINANCE NO 8719 ORDINANCE NO. 9107 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8719, ADOPTED ON OCTOBER 26, 1977, THE SUMMARY GRANT APPRO- PRIATIONS ORDINANCE, AS AMENDED; BY ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED: "RECREATION SUPPORT PROGRAM - 198011, AND APPROPRIATING A GRANT AWARD FROM THE COMMUNITY SERVICES ADMINISTRATION THROUGH METROPOLITAN DADE COUNTY FOR THE OPERATION OF SAME IN THE AMOUNT OF $25,689; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26, 1977, estaklishing resources and appropriations for grant funds anticipated by the City of Miami, Florida, and for corresponding City matching funds; and WHEREAS, the Community Services Administration through Metropolitan Dade County has approved a grant award of $25,689 to the City of Miami for a "Recreation Support Program - 1980"; and 0 WHEREAS, said grant award will allow the City to hire fifteen (15) Recreation Aides, rent five (5) vans, and allow the Department to buy additional program supplies as needed, as well as expand and improve recreational activities for economically disadvantaged youth from June 16 through August 15, 1980; and WHEREAS, said Recreation Aides will assist full time personnel currently employed with the Department of Leisure Services in providing the additional supervision of children participating in recreational activities for eight weeks during the summer; NOW,THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 8719, adopted October 26, 1977, as amended, is hereby further amended in the following particulars:1/ "Section 1. All ordinance or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining pro- visions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Consideration of amending Comprehensive Zoning Ordinance 6871 by amending Section 32 of ARTICLE IV GENERAL PROVISIONS to permit broadcasting towers to be located in any zoning district, upon rec- ommendation of the Planning Advisory Board and approval of the City Commission. REQUEST To permit broadcasting towers in any zoning dis- trict. BACKGROUND A request to build a broadcasting tower in Bis- cayne Bay, brought to the department's attention that there is no legislative framework (zoning) to consider such a request. By other terms of the Zoning Ordinance, most submerged land is auto- matically zoned R-1 not permitting such use. ANALYSIS Water areas are ideal for broadcasting facili- ties, yet only a limited number of facilities have been erected in this manner. Likewise, the number of such facilities is limited in the future due to the necessary spacing requirement of the towers. The required review process presently contained in Section 32 should properly control any undue concentration of the facilities.
