HomeMy WebLinkAboutPZAB (13722) Resolution° City of Miami City Hall 3500 Pan American Drive PZAB Resolution Miami, FL33133 r www.miamigov.com Enactment Number: PZAB-R-23-053 File ID: 13722 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB"), RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA ("MIAMI 21 CODE"), AS AMENDED, AMENDING ARTICLE 1, TITLED "DEFINITIONS" TO ADD AND MODIFY FRONTAGE -RELATED DEFINITIONS, AMENDING ARTICLE 4, TABLE 6 TITLED "FRONTAGES" AND TABLE 8 TITLED "DEFINITIONS ILLUSTRATED" TO MODIFY EXISTING FRONTAGE ILLUSTRATIONS AND DEFINITIONS, INTRODUCE A NEW LOGGIA FRONTAGE TYPE, ADD A NEW BUILD -TO -ZONE ILLUSTRATION, AND MODIFY THE LAYERS ILLUSTRATION, AMENDING ARTICLE 5, TITLED "SPECIFIC TO ZONES" TO MODIFY AND CLARIFY BUILDING FACADE REQUIREMENTS, MINIMUM HEIGHT REQUIREMENTS, ENCROACHMENT ALLOWANCES, AND REGULATIONS PERTAINING TO FIRST -LAYER PAVING AND LANDSCAPING WITHIN THE T5, T6, AND CI -HD TRANSECT ZONES, AMENDING ARTICLE 7, TITLED "PROCEDURES AND NONCONFORM ITIES" TO UPDATE THE WAIVER SUMMARY LIST, AMENDING ARTICLE 8 TITLED "THOROUGHFARES" TO INTRODUCE NEW SIDEWALK ILLUSTRATIONS, AND AMENDING ARTICLE 9 TITLED "LANDSCAPE REQUIREMENTS" TO ALLOW ADDITIONAL LOT TREES PLACEMENT FLEXIBILITY; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114 as the City of Miami's ("City") Zoning Ordinance ("Miami 21 Code"); and WHEREAS, the guiding principles of the Miami 21 Code state that architecture and landscape design should grow from local climate, topography, history, and building practice, and that buildings should allow their inhabitants to experience the geography and climate through energy -efficient design; and WHEREAS, an update to the objectives, requirements, and illustrations relating to the design of frontages, facades, sidewalks, and landscaping set out in the Miami 21 Code is needed; and WHEREAS, an amendment is necessary to increase Frontage architectural flexibility, clarify the First Layer requirements, and introduce provisions to resolve design challenges related to required grade changes; and City of Miami Page 1 of 26 File ID: 13722 (Revision:) Printed On: 5/26/2023 WHEREAS, the proposed frontage design flexibilities include replacing the Build -to Line definition with a new Build -to Zone, updating the allowable frontage types, and clarifying those circumstances in which stairs and ramps may be placed in the First Layer; and WHEREAS, an amendment is needed to allow additional flexibility for required onsite trees to be placed on the upper levels instead of the First Layer; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), has considered whether the proposed amendments will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and WHEREAS, PZAB has considered the Planning Director's recommendations and conducted a public hearing on the proposed amendment. NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI PLANNING, ZONING AND APPEALS BOARD Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. In the T5, T6, and CI -HD Transect Zones ground floor cantilevered Awnings and cantilevered enti canopies within the First Laver shall not be counted towards Lot Coverage. Right -of -Way, Public: That land held in trust by the City between the base building lines, including the Ssidewalk, swale and parkway area, and the roadway, street and highway, including a limited -access expressway. Section 3. Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by making modifications to Article 4 in the following particulars.2: ARTICLE 4 STANDARDS AND TABLES TABLE 6 FRONTAGES e. Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by making modifications to Article 5 in the following particulars.3: ARTICLE 5. SPECIFIC TO ZONES 5.5 URBAN CENTER TRANSECT ZONES (T5) 5.5.1 Building Disposition (T5) e.
