AN ORDINANCE BY THE MIAMI CITY COMMISSION AMENDING CHAPTER
10/ARTICLE I OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED "ELEVATOR/ESCALATOR FEES AND FINES FOR NON-
COMPLIANCE," TO INCLUDE FEES FOR BOILERS AND UNFIRED
PRESSURE VESSELS; CONTAINING A SEVERABILITY CLAUSE; PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, mechanical boilers operate by heating water within a vessel using gas, oil,
or coal. The heated water, either turned into steam or kept in liquid form depending on the type
of boiler, is then sent through a system of radiators placed throughout a structure in order to
provide indoor heating; and
WHEREAS, the City of Miami ("City") has over six hundred and fifty (650) commercial
and residential boilers; and
WHEREAS, that often these mechanical boilers in these commercial and residential
buildings become inoperable and have to be repaired causing a hardship to our residents, which
include disabled or senior citizens; and
WHEREAS, the City's Building Department is regularly called out to inspect these
mechanical boilers and often times will find expired Certificate of Operations; and
WHEREAS, the addition of the boiler and unfired pressure vessel fees are necessary in
order to hold owners and contractors accountable and are in the best interest of City residents;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.
Section 2. Chapter 10 of the City Code is amended in the following particulars:I
"CHAPTER 10
BUILDINGS
ARTICLE I. — IN GENERAL

added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted
and unchanged material.

Sec. 10-6. - Elevator/escalator/boiler and unfired pressure vessel fees and fines for non-
compliance.
(a) Fees.
Certificate of operations: $200.00 per elevator/escalator
Elevator/escalator duplicate certificate: $100.00 per elevator/escalator
Elevator/escalator delinquent certificate: $50.00 per elevator/escalator
Temporary certificate of operations: $100.00 per elevator/escalator
Elevator/escalator annual inspection: $200.00 per elevator/escalator
Elevator/escalator re -inspection fee: $100.00 per elevator/escalator
Elevator witness:
One-year test: $200.00
Five-year test: $250.00
Elevator emergency power/fire recall test: $1,000.00 per test
Elevator/escalator removal fee: $500.00 per elevator/escalator
High pressure boiler annual inspection: $135.00 per boiler
Low pressure boiler annual inspection: $135.00 per boiler
Water heater annual inspection: $85.00 per heater
Pool heater annual inspection: $85.00 per heater
Miniature boiler annual inspection: $85.00 per boiler
Kettles annual inspection: $85.00 per kettle
Unfired pressure vessel (air compressor) annual inspection: $85.00 per vessel
(b) Fines for non-compliance.
Elevator/escalator non-compliance fines:
First offense: $250.00 per elevator/escalator
Second offense: $500.00 per elevator/escalator
Third offense: $1,000.00 per elevator/escalator

Boiler. heater and unfired Dressure vessel non-compliance fines:
Re -inspection fee for every two (2) consecutive failed inspection: $50.00
Late fee for past due amounts: $40.00

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon adoption by the City
Commission.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
