HomeMy WebLinkAboutR-80-0478-CRESOLUTION NO. 8 O- 4 7 8 —C A RESOLUTION GRANTING A VARIANCE FROM _ ORDINANCE NO. 6871, ARTICLE XI-2, SECTION 6(1), TO PERMIT CONSTRUCTION OF A 180-UNIT APARTMENT PROJECT ON A PORTION OF BRICKELL POINT SUB (8-34) LYING EAST OF THE EASTERLY BOUNDARY LINE OF SE 2ND AVENUE BRIDGE APPROACH ACROSS THE MIAMI RIVER; ALSO THE INGRESS AND EGRESS OVER THAT CERTAIN EASEMENT GRANTED IN CHANCERY CASE NO. 54,811 OF THE CIRCUIT COURT OF DADE COUNTY, FLORIDA, BEING APPROXIMATELY 401 BRICKELL AVENUE, AS PER PLANS ON FILE, ALLOWING THE FOLLOWING: FOR THE PRINCIPAL STRUCTURE: (d) 15.677 PROPOSED LOT COVERAGE (13.1% REQUIRED); ZONED R-C-1 (RESIDENTIAL -OFFICE -COMMERCIAL). WHEREAS, the Miami Zoning Board, at its meeting of June 9, 1980, Item No. 1, following an advertised hearing, adopted Resolution No. ZB 109-80 by a 7 to 0 vote denying variance as hereinafter set forth; and WHEREAS, the applicant has taken an appeal from the denial of said variance to the City Commission; and WHEREAS, the City Commission notwithstanding the denial of the Zoning Board, and after careful consideration of this matter finds that due to peculiar circumstances affecting this parcel of land, practical difficulties and unnecessary hardships would impair the owner's right to the reasonable use of the property without the variance granted as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a variance as per Ordi- nance No. 6871, ARTICLE XI-2, Section 6(1), to permit con- struction of a 180-unit apartment project on a portion of BRICKELL POINT SUB (8-34) lying east of the Easterly boundary line of SE 2nd Avenue Bridge Approach across the Miami River; also the ingress and egress over that certain easement granted in Chancery Case No. 54,811 of the Circuit Court of Dade County, Florida, being approximately 401 di�CCUA1r�dT IR, r I, SO-478-C r Brickell Avenue, as per plans on file, allowing the follow- ing: FOR THE PRINCIPAL STRUCTURE: (d) 15.67% proposed Lot Coverage (13.1% required); zoned R-C-1 (Residential - Office -Commercial), is hereby granted.
