C 7 17 8-8 A RESOLUTION GRANTING A VARIANCE FROM ORDINANCE NO. 6871, ARTICLE XI-2, SECTIONS 3(2) AND 3(4)(a), TO PERMIT CON- STRUCTION OF A 180-UNIT APARTMENT PROJECT ON A PORTION OF BRICKELL POINT SUB (8-34) LYING EAST OF THE EASTERLY BOUNDARY LINE OF THE SE 2ND AVENUE BRIDGE APPROACH ACROSS THE MIAMI RIVER; ALSO THE INGRESS AND EGRESS OVER THAT CERTAIN EASEMENT GRANTED IN CHAN- CERY CASE NO. 54,811 OF THE CIRCUIT COURT OF DADE COUNTY, FLORIDA. BEING APPROXI- MATELY 401 BRICKELL AVENUE, AS PER PLANS ON FILE, ALLOWING THE FOLLOWING: FOR THE PRINCIPAL STRUCTURE: (a) WEST TOWER SIDE YARDS: 50.0' NORTH AND 43.67' SOUTH PRO- POSED (62.2' REQUIRED FOR BOTH); (b) EAST TOWER SIDE AND REAR YARDS: 50.0' NORTH AND 42.0' SOUTH PROPOSED (65.83' REQUIRED FOR BOTH); FOR THE ACCESSORY STRUCTURE: (a) SOUTH SIDE YARD: 21.0' PROPOSED (22.67' REQUIRED); ZONED R-C-1 (RESIDENTIAL - OFFICE -COMMERCIAL). WHEREAS, the Miami Zoning Board, at its meeting of June 9, 1980, Item No. 1, following an advertised hearing, adopted Resolution No. ZB 107-80 by a 7 to 0 vote denying variance as hereinafter set forth; and WHEREAS, the applicant has taken an appeal from the denial of said variance to the City Commission; and WHEREAS, the City Commission notwithstanding the denial of the Zoning Board, and after careful consideration of this matter finds that due to peculiar circumstances affecting this parcel of land, practical difficulties and unnecessary hardships would impair the owner's right to the reasonable use of the property without the variance granted as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a variance as per Ordi- nance No. 6871, ARTICLE XI-2, Sections 3(2) and3(4)(a), to permit construction of a 180-unit apartment project on a portion of BRICKELL POINT SUB (8-34) lying east of the Easterly boundary line of the SE 2nd Avenue Bridge Approach across the Miami River; also, the ingress and egress over "DOC tr EN'T i,xDEX ITEM l�0. 80- 1 78-8 that certain easement granted in Chancery Case No. 54,811 of the Circuit Court of Dade County, Florida, being approxi- mately 401 Brickell Avenue, as per plans on file, allowing the following: FOR THE PRINCIPAL STRUCTURE: (a) West tower side yards: 50.0' north and 43.67' south proposed (62.2' required for both); (b) East tower side and rear yards: 50.0' north and 42.0' south proposed (65.83' required for both); FOR THE ACCESSORY STRUCTURE: (a) South side yard: 21.0' proposed (22.67' required); zoned R-C-1 (Residential -Office -Commercial), is hereby granted.
