Peddling in Downtown Miami
The Cookie Coach Company of Florida, Inc. has requested a special license
to peddle in the downtown area. The Miami City Code, Section 40-4,
restricts this type of peddling, as follows:
"Soliciting within three hundred feet of established business;
locating or parking on highways, etc.
No peddler shall be permitted to solicit business upon the
public streets of the city within three hundred feet of an
established business handling the class of goods authorized
to be sold or handled under such license; nor to locate or
park on public highways or other public property within the
city for the purpose of transacting business."
Our interpretation of this section of the Code is that no peddler be
allowed to vend downtown because he will always be within three hundred
feet of a like business.
With this in mind, it is suggested that the Cookie Coach Company of.
Florida, Inc, petition the City Commission directly to obtain a special
occupational license to vend in the downtown area.
