Howard, Director Department of Leisure Services The purpose of this memorandum is to inform you of the departure of the vessel "Spirit of Miami" from Bicentennial Park, and the proposal for subsequent dockage of the "America." The "Spirit of Miami" operated from December of 1979 through the month of April, permitted and monitored by a User's Dockage Agreement. This dockage was authorized administratively pursuant to the recommendations of the Law Department in that: 1) it did not constitute a lease, and 2) the dockage rates exceeded those established by City Code, i.e., $500 per month and 1� percent of gross receips exceeding $750,000 (audit due within 60 days). Revenue from the "Spirit of Miami", excluding a percentage of gross receipts for 1979-80, is $2,500, with estimated revenue for the 1980-81 winter season to be $4,500, excluding the percentage of gross receipts. Subsequently, the City has granted a request from Acolex, Inc. for the dockage of a similar vessel, "America", which has been acclaimed the world's largest catamaran, accommodating up to four hundred (400). At the direction of the Law Department, a User's Dockage Agreement was executed with dockage fees of $750 per month and 2 percent of gross sales exceeding $500,000 for the months of June 25 through November 1, 1980. In regards to the City's expenditure of $12,000 for utility lines to service such vessels, continuance of dockage fees as described would recapture the expenditure within two years, which I am sure the City would consider a good investment. Grassie, City Manager Page 2 July 2, 1980 It should be noted that up until such time the City committed themselves to allow dockage of the "Spirit" (as per fees described in Chapter 50 of the City Code) no expenses were necessary on the City's behalf. It was later learned that increased service was necessary, thus the increase in dockage fees. Enclosed for your reference is a breakdown of expenditures required to install the necessary utilities for service of the vessels, and a fact sheet regarding dockage at the park. AHH/KDH/mf Encls.
