HomeMy WebLinkAboutR-80-0531Al "SUPPORTIVE DOCUMENTS L FOLLOW RESOLUTION NO. 8 0- 5 3 1 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE NATIONAL ASSOCIATION CB OF FLORIDA, INC. FOR THE USE OF FORTY-EIGHT (48) MOBILE RADIOS, IN CONFORMANCE WITH THE TERMS AND CONDITIONS AS SET FORTH IN THE ATTACHED AGREEMENT WHEREAS, the City of Miami has 48 mobile radios which are no longer service- able for City needs; and WHEREAS, these radios can serve no need within any administrative department of the City; and WHET:"AS, the National Association CB of Florida, Inc., will he able to utilize these radios for worthwhile uses and has requested that these radios be turned over to it; and WHEREAS, the leasing of these radios to the aforesaid association would serve a public purpose by reason of the significant impact upon the ability of the association to report suspicious persons, disturbances and crimes to the Miami Police Department Community Relations Divisions and to provide general assistance to citizens in need of services. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to execute an agreement with the National Association CB of Florida, Inc., for the use of 48 mobile radios during the period July 15, 1980 through July 15, 1981, in conformance with the terms and conditions as set forth in the attached agreement. OMMISSION MEETING OF JUL10 WO 0 80-531 el A LEASE AGREEMENT THIS LEASE AGREEMENT entered into this day of July, 1980, by and between the CITY OF MIAMI, a municipal corporation of the State of Florida, (hereinafter referred to as the "CITY"), and the NATIONAL ASSOCIATION CB OF FLORIDA, INC., (hereinafter referred to as "ASSOCIATION"). IN CONSIDERATION of the mutual agreements hereinafter set forth, the parties hereto agree as follows: THE CITY AGREES: 1. To lease to the "ASSOCIATION" certain radio equipment as described in the inventory statement attached hereto and made a part hereof by reference, for a rental fee of One dollar ($1.00) per year. 2. Subject to approval of the "CITY", the "ASSOCIATION" may classify certain of the leased equipment as "spare parts". Approval of such a request, shall not be unreasonably withheld provided the "ASSOCIATION" provides an itemized list of such equipment it requests to be so classified. THE ASSOCIATION AGREES: 1. That it shall provide monthly reports to Miami Police Department's Community Relations Division, listing: 1. Reports of suspicious persons. 2. Reports of disturbances. 3. Reports of services provided to citizens in need of assistance. 4. Reports of crimes observed. Reports so provided shall detail the dates of contact, location, name of citizen assisted or physical description of persons observed and disposition. 2. That the value of the leased radio equipment is hereby established as $2,400.00, for 48 units at $50.00 per unit. 3. The "ASSOCIATION" shall keep all equipment leased to it under this Agreement in good order and repair and shall be solely responsible to the City for its loss and destruction at the value for each unit as established by this Agreement. 4. The "CITY" shall have the right to terminate this Agreement by giving written notice to the "ASSOCIATION" at lease five days before said effective 80-531 r' � termination date if, through any cause, the "ASSOCIATION" shall fail to fulfill, in a timely and proper manner, its obligations under this Agreement or if "ASSOCIATION" shall violate the covenants or stipulations of this Agreement. BOTH PARTIES AGREE: 1. Title to radio equipment described in attached inventory statement re- mains with the "CITY". 2. The term of this Agreement shall he from July 15, 1980 to July 15, 1981 and may be renewed annually, at the "CITY's" discretion, for three (3) additional years upon review and approval by the City Manager or his designee.
