AN f:MBGENCY ORDINANCE PROVINNG FOR T111? 1101,UING OF
A BOND ELECTION IN THE CITY OF MIAMI,
FLORIDA, ON OCTOBER 7, 1980, WITH RESPECT
TO THE ISSUANCE OF $45,0001000 SANITARY -
SEWER BONDS; PROVIDING THAT THIS ORDINANCE —
SHALL GO INTO EFFECT IMMEDIATELY UPON ITS
PASSAGE; AND DISPENSING WITH THE READING OF
THIS ORDINANCE ON TWO SEPARATE DAYS BY A VOTE
OF NOT LESS THAN FOUR -FIFTHS OF THE COMMISSION.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:-
Section 1. Notice of the bond election heretofore
called by Ordinance No. - 9128 to be held on Tuesday, October
7, 1980, shall be published in THE MIAMI NEWS, the MIAMI
HERALD and
Diario Las
Americas
, newspapers
of general
circulation
published in
the City
of Miami,
Florida, at least twice, once in the fifth week and once in
the third week prior to the week in which said election is
to be held, the date of the first publication in each of said
newspapers to be at least 30 days before said election, which
notice shall be substantially in the following form:
NOTICE OF BOND ELECTION
To Be Held On
TUESDAY, OCTOBER 7, 1980
in
THE CITY OF MIAMI, FLORID,
As provided by Ordinance No. 9128 +, duly adopted by
the Commission of The City of Miami, Florida, an election
will be held on Tuesday,
October 7, 1980
for the purpose of submitting to the qualified electors of The
City of Miami, Florida, the following question:
"Shall bonds of The City of Miami, Florida, in an aggre-
gate principal amount not exceeding $45,000,000 be
issued under the provisions of Ordinance No. 9128 for
the purpose of paying the cost OF IMPROVEMENTS A,;D
EXTENSIONS OF THE SANITARY SEWER SYSTEM of said City,
such bonds to be issued at one time or from time to time
and to mature in annual installments 3 to 20
years, inclusive, after the date of the respective
bonds, to bear interest at a rate or rates not
to exceed the -rate provided for in the statutes of
the State of Florida and to be payable from un-
limited ad valorem taxes."
Such ordinance provides that for the prompt payment of
the principal of and the interest on such bonds there shall
be levied and collected annually an ad valorem tax upon all
taxable property within The City of Miami, over and above
all other taxes authorized to be levied by said City, sufficient
to pay such principal and interest as the same respectively
become due and payable.
The Commission of The City of Miami reserves the right
to make all or any part of such bonds redeemab:e prior to their
respective maturities at such times and prices and under such
terms and conditions as may be fixed by resolution prior to
the sale of the bonds.
The polls at said election will be open from 7:00 o'clock
A.M. until 7:00 o'clock P.M. of the same day.
The City of Miami shall be authorized to issue said bonds
if the question for the issuance of said bonds shall be approved
by a majority of the votes cast by the qualified electors of
The City of Miami voting on such question.
Said bond election shall be held at the polling places
in The City of Miami, in the several election precincts
designated by the Board of County Commissioners of Dade County,
as set forth below.

Section 2. A description of the registration books
and records which pertain to election precincts wholly or
partially with The City of Miami and which the City is
adopting and desires to use for holding such special bond
election is as follows:
All registration cards, books, records and certificates
pertaining to electors of The City of Miami and established and
maintained as official by the Supervisor of Elections of Dade
County, in conformity with the provisions of the general laws
of the State of Florida, are hereby adopted and declared to be,
and shall hereafter be recognized and accepted as, official
registration cards, books, records and certificates of such
City.
Section 3. Since the City of Miami has established the
permanent registration system under State law and the general
election laws of the State require 14 days prior approval by
the Board of County Commissioners of Dade County for acceptance
of branch office registration and that the registration books
be closed 30 days prior to the date of such bond election, regis-
tation for such bond election shall be at the office of the
Supervisor of Elections of Dade County, 1400 Biscayne Boulevard,
Miami, Florida.
Section 4. Said bond election shall be held at the
polling places in the several precincts, respectively,.in
the City as set forth in the foregoing NOTICE OF BOND ELECTION.
Not less than 20 days before said election the City Commission
shall designate the Inspectors of Election and Clerk of Election
for each precinct and shall publish the names of such Inspectors
of Election and Clerks of Election in a newspaper of general
circulation published in the City of Hiami at least 15 days
before the date of election.

Section 5. All qualified electors of the City shall
be permitted to vote in said bond election, and the Super-
visor of Elections of Dade County is hereby requested,
authorized and directed to furnish, at the cost and expense
of the City of Miami, a list of all qualified electors resid-
ing in the City of Miami as shown by the registration books
and records of her office, and duly to certify the same for
delivery to and use of the election officials designated to
serve at the respective polling places in said election
precincts.
Section 6. RALPH G. ONGIE, the City Clerk of the
City of Miami, Florida, is hereby designated and appointed
as the official representative of the City Commission in all
transactions with the Supervisor of Elections of Dade County
in relation to matters pertaining to the use of the regis-
tration books and the holding of said bond election. -
Section 7. The official ballot to be used at said
election shall be in full compliance with the laws of the
State of Florida with respect to absentee ballots and to the
use of Computer Election System (CES), and shall be in sub-
stantially the following form, to wit:

Section 8. Electors desiring to vote for the approval
of said Question described above shall be instructed to punch
straight down with the stylus through the hole next to the
word "FOR" within the ballot frame containing the statement
relating to the said Question; and, electors desiring to vote
against said Question shall be instructed to push straight
down with the stylus through the hole next to the word "AGAINST"
within the ballot frame containing the statement relating to
the said Question.
Section 9. The City Clerk shall cause to be prepared
absentee ballots containing the Question set forth in Sec-
tion 7 above for the use of absent electors entitled to cast
such ballots in said election.
Section 10. This ordinance shall go into effect immed-
iately upon its passage and shall not be subject to the right
of referendum as an ordinance.
Section 11. This ordinance is hereby declared an
emergency measure on the grounds of urgent public need for
the preservation of peace, health, safety, and property of
the City of Miami.
Section 12. The requirement of reading this ordinance
on two separate days is hereby dispensed with by a vote of
not less than four -fifths of the members of the Commission.
