AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI , BY CHANGING THE ?_ONIt1G CLASSIFICATION OF THE S45' OF LOT 8; RAINEY MANORS (61-94), BEING 790 N.W. 44TH AVENUE, FROM R-3 (LOW DENSITY MULTIPLE) TO C-4 (GENERAL C014TERCIAL) , RECOKIE-ND114G APPROVAL OF THE EXTENSION OF THE DISTRICT BOUNDARY LINF TO THE WEST, AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION IN ARTICLE. III, SECTION 2, THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY CLAUSE.. lv'IiEREAS, the Miami Zoning Board at its meeting of June 9, 1980, Item No. 3, following an advertised hearing, adopted s Resolution No. ZB 114-80 by a 7 to 0 vote RECOMMENDING change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE. CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of S45' of Lot 8; RAINEY MANORS (61-94), being 790 Northwest 44th Avenue, from R-3 (Low Density Multiple) to C-4 (General Commercial), recommending approval of the extension of the District Boundary Line to the West, and by making the necessary changes in the zoning district map made a part of said Ordinance No. 6871, by reference and description in Article III, Section 2f thereof. Section 2. That all laws or parts of laws in conflict herewith be and the same are hereby repealed insofar as they are in conflict. OF, Section 3. The proposed change of zoning from PLANNING DEPT. R-3 to C-4 would not be in conformance with the Comprehensive Neighborhood Plan which designates this entire block with the ex- ception of those properties which front on NW 7th Street, as moderate density residen- tial. This is astable multiple-family neighborhood whose character has not changed substantially in recent years. If the plumbing company south of this lot needs to expand, it would be more appropriate to construct any new structures which are needed on the main site and to provide con- ditional use parking on this lot. ZONING BOARD Deferrer! on March 17, 1980 by the applicant because of a short Board. Grassie City of Miami, Florida re: CfIANGE OF ZONING - RECOMMENDED 790 N.W. 44th Avenue S45' of Lot 8; RAINEY MANORS (61-94) Applicant: Manuel Menes Gentlemen: The Miami Zoning Board, at its meeting of June 9, 1980, Item #~3, following an advertised Hearing, adopted Resolution No. ZB 114-80 by a 7 to 0 vote RECOMMENDING Change of Zoning Classification of the S45' of Lot 8; RAINEY MANORS (61-94), being 790 N.W. 44th Avenue, from R-3 (Low Density Multiple) to C-4 (General Commercial), recommending approval of the extension of the District Boundary Line to the West. This change of zoning request was filed for all of Lot 8 of RAINEY MANORS SUBDIVISION (61-94). Thirteen objections received in the mail; two opponents present at ZB meeting. One reply in favor by mail; three proponents present at ZB meeting. An ORDINANCE to provide for this Change of Zoning has been prepared by the~ty Attorney's office and submitted for consideration by the City Commission.
