HomeMy WebLinkAboutO-09136ORDINANCE NO. 9136 AN ORDINANCE AMENDING ORDINANCE NO. 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, AS AMENDED, BY DELET- ING SUBSECTION (68) OF SECTION 1., ARTICLE XXV, BASE BUILDING LINES, AND INSERTING A NEW SUBSECTION (68) TO READ AS FOLLOWS: (68) 1ST AVENUE NE AND SE., NE 2ND STREET SOUTH TO SE 2ND STREET ...... 351; BY REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the Miami Planning Advisory Board, at its meeting of June 4, 1980, Item No. 2, following an adver- tised hearing, adopted Resolution No. PAB 18-80 by a 6 to 0 vote (2 members absent) recommending an amendment to Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami by deleting subsection (68) of. Section 1, Article XXV, BASE BUILDING LINES, and inserting a new subsection (68), as hereinafter set forth; and WHEREAS, the City Commission deems it advisable and in the best interest of the City of Miami and its inhabi- tants to amend said Ordinance, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That Ordinance No. 6871, the Comprehen- sive Zoning Ordinance of the City of Miami, as amended, is hereby further amended by deleting subsection (68) of Section 1, Article XXV, BASE BUILDING LINES, and inserting a new subsection (68) to read as follows: (68) Ist Avenue NE and SE, NE 2nd Street South to SE 2nd Street ........... 35f Section 2. All ordinances, code sections, or parts thereof in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction A-,, /ON to be invalid, the same shall not affect the validity of the ordinance as a whole. BACKGROUND: E. 1st Avenue, from NE 2nd Street to "Royal Palm Spur" which is approximately 120 feet south of SE 2nd Street is currently zoned to a street width of 701. By changing the Ordinance text, the street segment between SE 2nd Street and the "Royal Palm Spur" - distance of approximately 120'- would be reduced to a zoned street width of 50' which would conform to the existing right-of-way. ANALYSIS: The traffic carrying capacity of this segment of SE 1st Avenue is governed by the off -ramp from the I-95 feeder, by SF. 4th Street and by the 50 foot zoned street width of SE 1st Avenue from the I-95 feeder to the Royal Palm Spur, which dictate 3 moving lanes one-way northbound for a total of 36 feet plus 14 feet for curb and sidewalks. Changing the zoned street width from 70' to 50' would conform to this right-of-way. RECOMMENDATION: PLANNING DEPARTMENT: APPROVAL F PLANNING ADVISORY BOARD Recommended June 4, 1980. CITY COMMISSION: APPROVED on 1st reading, June 26, 1980.
