HomeMy WebLinkAboutR-80-0589OF r1 RESOLUTION NO. 8 0- 5 8 9 A RESOLUTION AUTHORIZING THE CITY MANAGER f TO EXECUTE A CONTRACT WITH METROPOLITAN ._ DADE COUNTY IN AN AMOUNT NOT TO EXCEED TWELVE THOUSAND DOLLARS ($12,000) FOR THE PURPOSE OF PROVIDING PLANNING DEPARTMENT SERVICES TO DEVELOP STRATEGIES AND PROGRAMS TO INCREASE MINORITY EMPLOYMENT IN THE CIVIC CENTER/GOVERNMENT CENTER AREA. WHEREAS, the continuing development of the Civic Center/ Government Center area indicates that employment opportunities are becoming available; and WHEREAS, it is the desire of the City Commission to foster a policy of increasing minority employment in this area; and WHEREAS, Metropolitan Dade County has proffered a contract for the purpose of providing Planning Department services for devel- oping strategies and programs for increasing minority employment in this area, funded through a County contract with the U. S. Depart- ment of Housing and Urban Development; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is authorized to execute a contract with Metropolitan Dade County in an amount not to exceed twelve thousand dollars ($12,000) for the purpose of providing ser- vices by the Planning Department to develop strategies and programs for increasing minority employment in the Civic Center/Government Center area; one-third of the contract amount to be represented by in -kind Planning Department services; with funding from a County/U.S. Department of HUD grant for an Urban Strategies Program. M1 71VE MEETING OF J U L ., 4 1980 DOCUMENTS MMUM14,o...g. 0 .5 8 9 FOLLOW" :..........�...�..... rs' 01 AGREEMENT BETWEEN DADE COUNTY AND CITY UN MIAMI FOR SERVICES IN CONJUNCTION WITH THE URBAN STRATEGIES PRUGRAM THIS AGREEMENT entered into as of this day of , 1980, by and between the City of Miami through its Planning Department, herein called the MPD (Miami Planning Department) and Metropolitan Dade County, through its Planning Department, herein called the DPD (Dade Planning Department). WITNESSETH THAT: WHEREAS, the DPD desires to engage the MPD to render certain professional services hereafter described in connection with an undertaking which is f financed under the County contract with the U.S. Department of Housing and Urban Development.. NOW THEREFOKE, the parties hereto do mutually agree as follows: I. Employment of Contractor. The DPU hereby agrees to engage the MPD and the MPD hereby agrees to perform the services hereinafter set forth in this Contractual Agreement. The MPD shall handle all contact with the UPD. The MPD shall execute the services hereinafter set forth only on notification from the DPU. II. Area Covered. The MPU shall perform all the necessary services provided under this Contract in connection with the respecting the political ` subdivision of the State of Florida known as Dade County. III. Scope of Services. In order to aid the UPI) in completing the Urban ► Strategy Project, the MPD agrees to complete the following activities: A. An Analysis of Conditions of Distress and Opportunity of Culmer-Overt.own Sub -Area. an older, existing, central city subarea including: "SUPPORTIVE DOCU M EN''S FOLLOW77 80-589 r 1. The description of past conditions of distress and opportunity in the subarea and of public policies, plans, and programs for responding to these condi- tions and their effectiveness. 2. The description of the present conditions of distress and opportunity in the subarea and of public policies, plans, and programs and their effectivensss. 3. The development of strategies and programs for the Subarea including: a. The location of major public and administration f employment centers within t.lte cent.ral city to provide opportunities for public service employ - meat for subarea workers; b. The expansion of opportunities for the provision of commercial and producer services to nearby centers of public and private regional employ - went, by subarea residents on businesses. C. The provision of an impetus to Lite development of balanced housing supply in Lite subarea and adjacent areas. 4. The development of strategies and programs for lever- aging of the investment in government employment in the downtown governmental center and the civic center to stimulate the physical and economic development of the Subarea including: a. Means of making residents aware of emerging ' employment opportunities in Lite adjacent Complexes. "SUPPORTIVE pOCMA ENTS FOLLOW 80-589 W b. Methods of encouraging minority business persona to provide commercial services that could be utilized by workers in adjacent employment centers. c. Approaches to assisting minority business persons to provide producer services to these major employ - meat centers. 5. The development of strategies and programs for introducing balanced income and ownership housing within the Subarea vicinity with particular emphasis on in -filling of vacant I land. 6. The conduct and analysis of a survey of city employees currently employed or expecting to be employed in the governmental center as to their housing location and type preferences. This survey will be coordinated with a similar one to be conducted by UPU for county employees. B. Identification of Potential Application of Culmer-Uvertown Subarea Strategy and Programs to Other Central City Dis- tressed and Opportunity Subareas and To a Metropolitan -wide Urban Strategy and Program. C. Publication of 100 Copies of a Final Report summarizing the activities described in Section III A 6 B. U. Participation In and Coordination Of Other Tasks of the Urban Strategy Refinement: Program - including serving on Technical Committee. "SUPPORTIVE DOCUMENTS FOLLOW" r e*1 IV. Personnel. The MPU represents that it has, or will secure at its own expense, all personnel required in performing the services under this contract, designated as the MPU's responsibility. Such personnel shall not be employees of the UPU. Personnel engaged in the work shall be fully qualified and shall be authorized under state and local law to perform such services. None of the work or services covered by this Contract shall be subcontracted without the prior written approval of ti►e UPU. V. Time of Performance. The services of ti►e MPU are to be available to the UPU immediately upon ti►e execution of this Contract but in order to provide continuity will include any of ti►e services described in Section III which have been provided to the UPU or since June 1, 198U. All services shall be undertaken and cumpleted in such sequence as to assure their expeditious completion in the light of the purposes of this Contract, but in any event all of the services required hereunder shall be completed by November 30, 1981. VI. Liaison. Tile Contractor shall bear the responsibility of main— taining close liaison with ti►e UPU. VII. Compensation. The cost of the services provided by the MPU shall not exceed the following amounts: A. Analysis of Conditions of Distress and Opportunity: $8,bUU. B. Identification of Potential Application of subarea strategy and programs: $2,2UO C. Publication of Final Report: $8UU U. Participation in and cuurdination with other tasks of the Urban Strategy Refinement Program: $40U The cost of any of the above tasks may exceed ti►e indicated cost by 10 pervent (10%) provided ti►e total cost dues not exceed $12,000. "SUPPORTIVE DOCUMENTS FOLLOW" J 00, The MPU shall be compensated by UPU for 2/3 of the cost of the activities described above. The MPU shall contribute 1/3 of the cost of the activities as in -kind contributions to the total program and shall maintain and provide ` the necessary documentation of the contribution of the in -kind services. VIII. Method of Payment. Tile MPU shall submit monthly invoices requesting compensation and documenting in -kind contributions of services including a status report on the several tasks described in Section III, and the percentage of completion of each task and subtask. The UPU shall compensate the MPU for a corresponding percentage of completion of tasks described in Section III A amd 8 up to 90 percent completion and for the remaining compensation upon com- pletion of draft reports, provided that all compensation for activities covered in Section III C will be paid in full upon receipt of the copies of Lite final t reports and invoice. Monies under such vouchers are due and payable within thirty (3U) days of receipt and approval of such invoices. IX. Termination of Contract for Cause. If, through any cause within the MPU's control, it shall fail to fulfill in timely and proper manner its obligations under this contract, or if the City shall violate any of the covenants, agreements or stipulations of this contract, the UPU shall thereupon have the right to terminate this Contract by giving written notice to the MPU of such termination and specifying the reason therefor and effective date thereof, at least fifteen (15) days before the effective date of such termination. In such event, all finished or unfinished documents, data, studies and reports prepared by Lite MPU under this Contract shall, at ti►e option of the UPU, become its property and the Contractor shall be entitled to receive just and equitable compensation for any satisfactory work completed on such documents. Notwithstanding the above, the MPU shall not he relieved of liability to the UPU for damages sustained by the UPU by virtue of any breach of the Contract by the MPU, and Lite UPU may withhold any payments to the Contractor "SUPPORTIVE DOCUMENTS FOLLOW" OF v for the purpose of offset until such time as the exact amount of damages due the DPD from the Contractor is determined. X. Termination for Convenience of Planning Agency. The DPD may terminate this Contract at any time by giving at least fifteen (15) days prior written notice to the MPU of such termination and specifying the effective date thereof. If the Contract is terminated by cite DPD as provided herein, the MPU will be paid in full for all services performed, plus all out-of-pocket expenses incurred to the effective date of termination. XI. Changes. The UPU may, from time to time, request changes in scope of the services of the MPU to be performed hereunder. Such changes, including any increase or decrease in the amount of Lite MPD's curipensat.ion, which are mutually agreed upon by and between the DPD and the MPU shall be incorporated in written amendments to this Contract. XII. Equal Empluyment Opportunity. During the performance of this Contract, the MPU agrees as follows: A. The MPD will not discriminate against any employee or applicant for employment because of race, creed, color, sex, or national origin. The City will take affirmative action to ensure that applicants are employed, and that employees are treated during employ- ment without regard to their race, creed, color, sex or national origin. Such action shall include, but not limited to the following; recruitment or recruit- ment_ advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The MPU agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the CPU setting forth the provisions of this non- discrimination clause. The MPD shall, in all solicitations or advertisements for employees placed by or on behalf of the MPD, state that all qualified applicants will receive consideration for employment without regard to race, creed, color, sex or national origin. C. The MPD shall cause the foregoing provisions to be inserted in all subcontracts for any work covered by this Contract so that such provisions will be binding upon each subcontractor provided that the foregoing provisions shall not apply to contracts or subcontracts for standard commercial supplies or raw materials. t XI11. Discrimination Because of Certain Labur PlatA ers. No persons employed on the work covered by this Contract. shall be discharged or in any way discriminated against because they have filed any complaint or instituted or caused to be instituted any proceeding or have testified or are about to testify in any proceeding under or relating to the labor standard applicable hereunder to their employer. XIV. Compliance with Local Laws. The MPD shall comply with all applica- ble laws, ordinances and codes of the state and local governments and shall commit no trespass on any public or private property in performing any of the work embraced by this Contract. The MPD agrees to abide and be governed by Dade County Ordinance 72-82 (Conflict of Interest: ordinatire), as amended, which by reference is incorporated herein, in connection with its Contract obligation hereunder. XV. Assignability. The MPD shall not assign ally interest in this Contract, and shall not transfer any interest in the same (whether by assignment or notation) without the prior written approval of the DPD. Provided, however, that. claims for money due, or to become due, the MPD from the DPD under this Contract may be assigned to a bank, trust company or other financial institution, or to a Trustee in Bankruptcy, without such "SUPPORTIVE DOCUMENTS FOLLOW" 10 approval. Notice of any such assignment or transfer shall be furnished promptly to the DPD. XVI. Interest of Members of County Agency. No member of the governing body of the DPD, and no other officer, employee or agent of the DPO who exercises any functions or responsibilities in connection with the carrying out of the Project to which this Contract pertains, shall have any personal interest, direct or indirect, in this Contract. XVII. Interest of Other Local Public. Officials. No member of the governing body of the locality in which the Project Area is situated, and other official of such locality, who exercises any functions or responsibilities in the review or approval of the carrying out of the Project to which this Contract pertains, -- shall have any personal interest, direct or indirect, in this Contract. XVIII. Interest of Certain Federal Officials. No member of, or delegate to the Congress of the United States, and no Resident Commissioner, shall be admitted to any share of part of this Contract, or to any benefit to arise herefrom. XIX. Identification of Documents. The format and manner of identification of the Contractor on all reports, maps and other documents completed as a part of this Contract, other than documents prepared exclusively for internal use within the DPD, shall be approved by the DPD and shall carry the following notation on the same page (or in the case of maps, in the same block) containing the name of the DPU: The preparation of this report was financially aided through a federal grant from the Department of Housing and Urban Development., under the Urban Planning Assis- tance Program, authorized by Section 7U1 of the Housing Act of 1954, as amended. ..* together with the date (month and year) the document was prepared and the name of the planning area concerned. "SUPPORTIVE DOCUMENTS FOLLOW" XX. Copyright. No reports, maps or other documents produced in whole or in part under this Contract shall be the subject of any application for copyright by or on behalf of the MPD. Grassie City Manager Am Reid, Director Planning Department ,,ITY OF M1 W. i I-0,41DA • INTER•k:`-FICE mE`• ORANDUM July 16, 1980 Authorization To Execute Contract with Metro Dade County For Urban Strategy Program Services It is recommended that the City Manager be authorized to execute _. a contract with D,fetro Dade County in an amount not to exceed twelve thousand dollars ($12,000) for the purpose of providing services by the Planning Department with the •- objective of developing strategies and programs for increasing minority employment in the Civic Center/ Government Center area, per the, attached resolution. •• The continuing development in the Civic Center/Government Center supports the need to closely evaluate employment opportunities and propose strategies and programs to increase minority employ- ment in this area. The Metro Dade County Planning Department has contracted with the U. S. Department of Housing and Urban Development (HUD) to prepare an Urban Strategies Program. The County has proffered a contract (attached) which proposes to use part of the HUD grant to engage the services of the Planning Department to develop strategies and programs for increasing minority employment in the Civic Center/Government Center area. The amount of the contract is $12,000; 1/3 or $4,000 to be in the form of in -kind planning services of Planning Department staff already budgeted through other grants. It is requested that this item be included on the City Commission Agenda of July 24, 1980. Attachment O 5 S V 1
