HomeMy WebLinkAboutR-80-0676.21 RFC/wpc 9/11/80 RESOLUTION NO. 8 0 - 6 7 6.2 A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 4TH DAY OF NOVEMBER, 1980, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF MIAMI FOR THEIR APPROVAL OR DISAPPROVAL, A MEASURE KNOWN AS "CHARTER AMENDMENT NO. 1", AMENDING SUBSECTION 56(I) OF THE CHARTER OF THE CITY OF MIAMI, FLORIDA, BY PROVIDING THAT THE AMOUNT OF CASH PAYMENT DUE A CON- TRACTOR PERFORMING A LOCAL IMPROVEMENT CONSTRUCTION CONTRACT AND WHICH PAYMENT IS RETAINED BY THE CITY FOR UP TO 60 DAYS AFTER THE CITY'S ACCEPTANCE OF THE COMPLETED LOCAL IMPROVEMENT CONSTRUCTION BE REDUCED FROM 10% TO 2h% OF THE ESTIMATED CONTRACT COST; DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY HEREOF TO BE DELIVERED TO THE SUPERVISOR OF ELEC- TIONS OF DADE COUNTY NOT LESS THAN FORTY-FIVE DAYS PRIOR TO THE DATE OF SUCH SPECIAL MUNICIPAL ELECTION. WHEREAS, the City Commission, at a regular meeting duly called and held according to law on the 15th day of. September, 1980, duly passed and adopted Resolution No. 80- , which set forth a proposed Charter Amendment No. 1 amending Subsec- tion 56(I) of the City Charter; and WHEREAS, said proposed amendment shall become effective in the event that it is approved by a majority of the quali- fied electors of the City of Miami voting at a special muni- cipal election held for the purpose of enabling said electors to register their approval or disapproval of said proposed amendment; and WHEREAS, it is appropriate and necessary that the City Commission make provision for holding said special municipal election; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION 0 THE "-I'll CITY OF MIAMI, FLORIDA: uocu��� tjEq.NO. Section 1. A special municipal ec ion .is hereby called and directed to be held in the City of Miami, Florida, from 7:00 A.M. until 7:00 P.M. on Tuesday, the 4th day of November, 1980, for the purpose of submitting to the qualified electors. of the City of Miami for their approval or di measure known as Charter Amendment No. 1. Said special municipal election shall be held at the voting places in the precincts designated, all as shown on the list attached hereto and made a part hereof and referred to as Exhibit No. 11 or as may be designated by the Supervisor of Elections of Dade County, in conformity with the provisions of the general laws of the state. A des- cription of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is adopting and desires to use for holding such special municipal election is as follows: All regis- tration cards, books, records and certificates pertaining to electors of the City and established and maintained as official by the Supervisor of Elections of Dade County, in conformity with the provisions of the general laws of the state, are hereby adopted and declared to be, and shall here- after be recognized and accepted as, official registration cards, books, records and certificates of the City. Section 3. The ballot to be used in said election shall be so prepared as to comply with the laws of the State of Florida with respect to absentee ballots and to the use of mechanical voting machines for the Computer Election System (CES ). Section 4. In compliance with Florida Statute 100.342, the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein resolution and of the provisions hereof, at least twice, once in the fifth week and once in the third week prior to the week in which the afore- said special referendum election, as herein set forth, is to be held in the following newspapers published within the City of Miami, Florida: THE MIAMI HERALD THE MIAMI NEWS DIARIO LAS AMERICAS THE MIAMI 'TIMES THE LIBERTY NEWS, which notice shall be substantially as set forth in the follow- ing form: 2 80-6'76.2 NOTICE OF SPECIAL REFERENDUM ELECTION TO BE HELD ON TUESDAY, NOVEMBER 4, 1980 IN THE CITY OF MIAMI, FLORIDA PURSUANT TO RESOLUTION NO. 80- A special referendum election will be held on Tuesday, November 4, 1980, from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida at the polling places designated and set forth herein, for the pur- pose of submitting to the qualified electors of the City of Miami, Florida, the following question: "CHARTER AMENDMENT NO. 1: Shall subsection 56(I) of the Charter of the City of Miami be amended to provide that the amount of cash payment due a contractor per- forming a City local improvement construction contract and which payment is retained by the City for up to sixty (60) days after the City's acceptance of the completed local improvement construction be reduced from ten percent (10%) to two and one-half. percent (2'%) of the esti- mated contract cost? Section 5. The City Clerk shall cause to be prepared absentee ballots containing the Question set forth in Section 4 above for the use of absent electors entitled to cast such ballots in said election. Section 6. All qualified electors of the City shall be permitted to vote in said special municipal election and the :7 Supervisor of Elections of Dade County is hereby requested, authorized and directed to furnish, at the cost and expense of the City of Miami, a list of all qualified electors in the City of. Miami as shown by the registration books and records of his or her office and duly to certify the same for delivery to and use of the election officers designated to serve at the respective polling places in said election precincts. Section 7. For the purpose of enabling persons to regis- ter who are qualified to vote in said special municipal elec- tion to be held on November 41 1980, and who have not regis- tered under the provisions of the general laws of Florida and Chapter 15 of the Code of the City of Miami, or who have trans- ferred their legal residence from one voting precinct to another voting precinct in the City, they may register at the 3 8 0 - 676.1 following permanent branch offices as approved by the Supervisor of Elections of Metropolitan Dade County, Florida, which are hereinafter set forth and which will be open during the fol- lowing dates and times: ELECTIONS DEPARTMENT 1400 Biscayne Boulevard, Miami, Florida Tue. - Sat. Sept. 29 - Oct. 3, 1980 9:00 a.m. - 5:00 p.m. In addition to the above times and places, said qualified persons may register at such other branch offices and may also use the mobile registration van for the purpose of registration in order to vote in the herein described election during such times and on such dates as shall be designated by the Supervisor of Elections for Metropolitan Dade County. Section 8. RALPH G. ONGIE, the City Clerk of the City of Miami, Florida, is hereby designated and appointed as the official representative of the City Commission in all trans- actions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of the herein special municipal election. The election clerks and inspectors to serve at said pol- ling places shall be those designated by the Supervisor. of Elections of Metropolitan Dade County for such purpose. Section 10. The proper officials of the City of Miami and Dade County are hereby authorized and directed to submit said Question to the electorate at the November 41 1980 special municipal election and to certify the result thereof to the Commission of the City of Miami, Florida, and all acts per- taining to said election heretofore performed by said officials 4 80-67G.2 are hereby ratified and confirmed. Section 11. The City Clerk shall deliver a certified copy of this resolution to the Supervisor of Elections for Metropolitan Dade County not less than forty-five days prior to the date of the herein special municipal election.
