IN CONJUNCTION THEREWITHt TO BE HELD ON OCTOBER 22, 23, 241 25 AND 26, 1980; FURTHER CON- DITIONALLY CLOSING CERTAIN STREETS IN THE CITY DURING DESIGNATED TIMES SUBJECT TO INSURANCE OF PERMITS BY THE POLICE AND FIRE DEPARTMENTS. t BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to exe- cute the attached agreement with the non-profit organization known as the Coconut Crove Bicycle Club, Inc. for the purposes of conducting the GREAT COCONUT.' GROVE BICYCLE RACE and providing r the necessary Police services by the City of Miami Police Depart- ment in conjunction therewith, to be hold on October 22, 23, 24, 25 and 26, 1980. Section 2. The following closures are subject to the proper execution of the attached agreement, as well as to the further r issuance of permits as provided herein: a. E. 2nd Avenue; N. E. 2nd Avenue south to Brickell Avenue; Brickell Avenue south to South Bayshore Drive; and South Bay - shore Drive south to 100 yards north of McFarlane. c. The following streets are hereby closed between 8:00 A.M. and 5:00 P.M. on Sunday, October 261 1980, for the holding of The Great Coconut Grove Bicycle Race, subject to issuance of permits by the Police and Fire Departments: East on South Bayshore Drive to Mary Street; North on Mary Street to Grand Avenue; Nest on Grand Avenue to Commo- dore Plaza; South on Commodore Plaza to Main Highway; Northeast on Main Highway to McFarlane; and South on McFarlane to South Bayshore. The Great Coconut Grove Bicycle Race, an annual event sponsored by the Coconut Grove Bicycle Club, Inc., is planned to be held on October 22nd through the 26th, 1980. The City of Miami's involvement in this event includes Police personnel for traffic control and the closing of streets during the various races. The attached Agreement specifies both the City's contribution and com- mitments and those of the Coconut Grove Bicycle Club, Inc, in detail. crn ` ~! DOCUP•JENTS' FOLLOW" 8- 0 - 6 7 AGREEMENT THIS AGREEMENT made the day of 1980, between the CITY OF MIAMI, a Municipal Corporation of the State of Florida, (hereinafter called "The CITY"). The COCONUT GROVE BICYCLE CLUB, INC., a non-profit organization, as prime sponsor of the Great Coconut Grove Bicycle Race, (hereinafter referred to as "PRIME SPONSOR"). i_if roarccr-rii WHEREAS, the City has received a request for in -kind services and other support from the PRIME SPONSOR for The Great Coconut Grove Bicycle Race to be held on October 22, 23 and 24, 1980, between the hours of 9:00 A.M. and 12:00 Noon, each day; a point to point road race from Coconut Grove to Miami Beach and back to be held on October 25, 1980 at 7:00 A.M.; and for The Great Coconut Grove Bicycle Race to be held on Sunday, October 26, 1980, between the hours of 8:00 A.M. and 5:00 P.M. NOW, THEREFORE, in consideration of the mutual covenants and con- ditions herein contained, it is agreed by the parties hereto as follows: THE CITY AGREES: 1. To provide the following services at no charge to the PRIME SPONSOR: a. Police services, consisting of 2 police officers on October 22, 23 and 24, 1980 for three hours; a minimum of 3 motorcycle officers or additional personnel as determined by the Police Department on October 25, 1980 for approximately 3 hours. 2. Police services on an off -duty basis: Ten motorcycle officers for three hours on October 25, 1980 and other personnel as may be required by the Police Depart- ment for public safety and requested by the PRIME SPONSOR on an off -duty basis. Three officers and one sergeant for ten hours on October 26, 1980. THE PRIME SPONSOR AGREES: To indemnify and save harmless forever the CITY, and all the CITY's officers, agents, and employees from all charges or claims resulting in any personal injury, loss of life, or damage to property, from any act, omission or neglect, by it self or itsl-,mployees; the PRIME SPONSOR shall become defendant in every suit brought for any of such causes of action against the CITY or the CITY's officials, agents and employees; the PRIME SPONSOR shall further indemnify CITY as to all costs, attorney's fees, expenses and liabilities incurred in the expense of any such claims and the investigation thereof.
