Home My WebLink AboutR-80-06624EL RESOLUTION NO. 8 0- 6 6 2 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE PUBLIC HEALTH TRUST OF DADE COUNTY, FLORIDA WHICH OPERATES JACKSON MEMORIAL HOSPITAL, AND THE UNIVERSITY OF MIAMI FOR THE COORDINA- TION OF EMERGENCY MEDICAL SERVICES, SUBSTANTIALLY IN ACCORDANCE WITH THE TERMS AND CONDITIONS SET FORTH IN THE ATTACHED AGREEMENT; WITH FUNDS THEREFOR ALLOCATED THROUGH THE FIRE DEPARTMENT'S GENERAL OPERATING BUDGET „SUPPORTIVE FOLLOW" WHEREAS, The City of Miami, the Public Health Trust of Dade County, and the University of Miami desire to cooperate to provide services in connec- tion with the Emergency Medical Services provided by the Rescue Division of the City of Miami Fire Department; and WHEREAS, the funds are allocated through the Fire Department's general operating budget; and FLORIDA: WHEREAS, the City Manager recommends approval; NOW, THEREFORE, BE IT RESOLVED SY THE COMMISSION OF THE CITY OF MIAMI, Section 1. 'rile City Manager is hereby authorized to enter into an Aareement with the Public Health Trust of Dade County and the University of Miami for services in connection with the Emergency Medical Services provided by the Rescue Division of the City of Miami Fire Department, in accordance with the terms and conditions as set forth in the attached Agreement. Brice, Director Department of Fire August 11, 1980 Agenda Item for City Commission Meeting of September 15, 1980 Approval of Rescue Agreement Orig. and 4 copies of Agreement Orig. and 4 copies of Resolution I recommend that the City Manager enter into an Agreement with the Public Health Trust of Dade County which operates Jackson Memorial Hospital, and the University of Miami for the coordination of Emergency Medical Services, substantially in accordance with the terms and conditions set forth in the attached agreement; with funds allocated through the Fire Department's General Operating Budget, as per the attached Resolution. The Agreement forwarded herewith is a continuation of the Emergency Rescue Agreement which expired on June 30, 1980, in which the University of Miami provides a qualified Medical Director to supervise house staff members at Jackson Memorial Hospital in their response to our Rescue Units' radio transmissions. The new Agreement is for one year, commencing 7/1/80. The annual compensation under this Agreement remains at $10,000, to be paid quarterly. This sum is included in the Fire Department's annual general operating budget. The Law Department has reviewed this Agreement and it has been executed by all parties except for the City Manager. The appropriate Resolution, also enclosed, has also been reviewed and approved by the Law Department. V� FpLL��Vlj S 80- 662 004 elk AGREEMENT BETWEEN CITY OF MIAMI AND UNIVERSITY OF MIAMI AND PUBLIC HEALTH TRUST OF DADE COUNTY, FLORIDA THIS AGREEMENT, entered into this day of lg , by and between the City of Miami, a munic pal corporation of t e State of Flor da, (hereinafter referred to as the "CITY") the Public Health Trust of Dade County, Florida, an agency and instrumentality of Dade County, Florida (hereinafter referred to as the "TRUST") which operates Jackson Memorial Hospital (hereinafter referred to as "HOSPITAL"), and the University of Miami (hereinafter referred to as the "UNIVERSITY"). W I T N E S S E T H WHEREAS, the CITY, the TRUST, and the UNIVERSITY desire to cooperate to provide certain services in connection with the Emergency Medical Services provided by the Rescue Division, City of Miami Fire Department. NOW THEREFORE, in consideration of the promises and the mutual covenants and agreements herein contained, the parties hereto agree as follows: A. The TRUST agrees: 1. To provide support in the form of licensed house staff members from HOSPITAL, each of whom is qualified to practice medicine at HOSPITAL and is fluent in the English language. Said physicians will be available on a 24-hour basis for prompt response to emergency medical radio transmissions from CITY Fire Department Rescue Units, B. The UNIVERSITY agrees: 1. To provide a qualified Medical Director, acceptable to the CITY and TRUST, to provide support in accordance with State of Florida laws and regulations to the Emergency Medical System of the CITY. Said Medical Director (or his alternate, as provided for in paragraph B,2,) shall supervise house staff members of HOSPITAL who are provided by the TRUST for prompt response to emergency medical radio transmissions from CITY Fire Department Rescue Units. (Period: July 1, 1980 - June 30, 1981) 2. To provide alternate physicians, acceptable to the Medical Director, TRUST, and to CITY, in order to endeavor to insure that qualified relief supervision is always provided during the Medical Director's absence from the system. 3. That the Medical Director and his alternates shall be fluent in the English language and qualified to practice medicine at HOSPITAL. 4. To provide legal services as may be required by the Medical Director in the performance of his responsibilities. C. The CITY agrees: 1. To pay to the UNIVERSITY as compensation for services, the annual sum of Ten Thousand Dollars ($10,000.00) payable in equal quarterly installments, to be used as deemed appropriate by the UNIVERSITY. 2. That all paramedical personnel assigned to advanced life support vehicles will be approved by the Medical Director and the Fire Chief of the Rescue Division. 3. To provide to the Medical Director a list of equipment carried on the advanced life support vehicles which list shall be in accordance with the equipment required by regulations of the Department of Health and Rehabilitative Services and the State of Florida Statutes 401. 4. To carry said equipment on all fire rescue vehicles used. In the event that the Medical Director determines that the equipment listed does not meet the requirements of the regulations, the CITY agrees that it will immediately take the necessary action to bring the equipment carried on the advanced life support vehicles into compliance with the regulations. D. All parties agree that: 1. The CITY, as allowed by law, shall indemnify and hold harmless the UNIVERSITY, Dade County and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the CITY which may arise during the period that care, custody and control of a patient is in the hands of a rescue squad of the Rescue Division and, at its own cost and expenses shall defend Dade County, the UNIVERSITY, the TRUST, and any of their respective officers, trustees or employees against any such claim brought against any of them. 2. The UNIVERSITY agrees to indemnify and hold harmless the CITY, Dade County and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the UNIVERSITY which may arise during the period that care, custody and control of a patient is on the hands of a rescue squad of the Rescue Division and at its own cost and expense, shall defend the CITY, Dade County, and TRUST and any of their respective officers, trustees or employees against any such claim brought against any of them. All parties will comply with Florida Statutes, Sections 401.21 through 401.47 and the implementing regulations promulgated by the Department of Health and Rc-habilitative Services, 6.
