AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO.
9019, ADOPTED NOVEMBER 8, 1979, THE CAPITAL IMPROVE-
MENT APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR
ENDING SEPTEMBER 30, 1980, AS AMENDED, BY ESTABLISH-
ING PROJECT III.C.1., "UNDERGROUND FUEL FACILITY",
AND BY TRANSFERRING SAME TO THE CAPITAL IMPROVEMENT
FUND, NEW PROJECTS, ESTABLISHING X.C.(i)3. IN THE
AMOUNT OF $76,900, WITH FUNDS IN THE AMOUNT OF
$46,000 TO BE APPROPRIATED FROM THE 1976 FIRE FIGHTING,
FIRE PREVENTION AND RESCUE FACILITIES BOND FUND, AND
$30,900 TO BE APPROPRIATED FROM THE MOTOR FUEL ACCOUNT
OF HEAVY EQUIPMENT MAINTENANCE DIVISION, THE DEPARTMENT OF
BUILDING AND VEHICLE MAINTENANCE; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE AND DISPENSING WITH
THE REQUIREMENT OF READING THE SAME ON TWO (2) SEPARATE
DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE
MEMBERS OF THE CITY COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9019 on
November 8, 1979, establishing resources and appropriations for
the implementation of capital improvements in the City of Miami,
Florida for the Fiscal Year ending September 30, 1980; and
WHEREAS, during the previous oil embargo, the Department
of Fire experienced difficulty in the delivery of gasoline and
diesel fuel due to the fact that vendors considered the existing
fuel tank installations too small to accommodate sufficient
quantities for reliable, continuous delivery; and
WHEREAS, vendors have suggested the installation of larger
tanks to ensure regular gasoline and diesel fuel delivery, parti-
cularly in the event of another oil embargo; and
WHEREAS, the installation of this fuel facility will
increase the City's fuel storage capacity and will result in
lower cost per gallon of fuel; and
WHEREAS, the lowest bid received for the installation of
this fuel facility is $64,897.72, in addition to which the amount
of $12,000 will be required for Public Works Department charges,
for a total of $76,897.72; and
WHEREAS, funds are available in the amount of $46,000
from the 1976 Fire Fighting, Fire Prevention and Rescue Facil-
ities Bond Fund and in the amount of $30,900 from the Motor
Fuel Account of the Heavy Equipment Maintenance Division of the Department
of Building and vehicle Maintenance;
NOW, THEREFORE, -BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance 9019, adopted November
8, 1979, as amended, is hereby further amended in the following
particulars:

made by fund and project title include previously
authorized projects and fund appropriations for
implementation of all municipal capital improve-
ments of the City of Miami, Florida. The sources
of revenue to support the herein appropriations
are hereby identified by fund and project:

Section 2. All ordinances or parts of ordinances, insofar
as they are inconsistent or in conflict with the provisions of this
ordinance, are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

Section 4. The requirement of reading this ordinance on
two (2) separate days is hereby dispensed with by a vote of not
less than four -fifths (4/5) of the members of the Commission.

Draft of Amendatory Ordinance
The Department of Fire and the Department of
Building and Vehicle Maintenance recommends
adoption of an amendatory ordinance to the
79-80 Capital Improvement Appropriations
Ordinance 9019, to provide funds for the
installation of a fueling facility (3 10,000
gallon fuel tanks) at 1300 N.W. 20th Street.
Funds are available in the 1976 Fire Fighting,
Fire Prevention and Rescue Facilities Bond
Fund in the amount of $46,000 and in the Motor
Fuel Account of the General Operating Budget of
the Department of Building and Vehicle Mainten-
ance in the amount of $30,900.
During the last fuel crisis, the City of Miami and, in particular,
the Department of Fire, experienced difficulty in obtaining suffi-
cient fuel supplies. In order to avoid this serious problem in
the future, specifications were prepared for a fueling facility
to accommodate larger quantities of'motor fuel. The resolution for
the award of bid on this fueling facility is scheduled for the
September 15, 1980 City Commission Agenda. It is requested that
the attached amendatory ordinance be scheduled for City Commission
approval at the same meeting, September 15, 1980. The amount of
bid was $64,897.72; Public Works charges are $12,000; total is
$76,900.
