AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO.
9019, ADOPTED NOVEMBER 8, 1979, THE CAPITAL IMPROVEMENT —
APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING
SEPTEMBER 30, 1980, AS AMENDED; BY ESTABLISHING, PROJECT
I.C.2., STREET SWEEPERS, IN THE AMOUNT OF $129,300; BY
DECREASING PROJECT I.8.1, SOLID WASTE OPERATIONS FACILITY,
IN THE SAME AMOUNT; FOR THE PURCHASE OF THREE (3) STREET
SWEEPING MACHINES; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 901.9 on November 8,
1979, establishing resources and appropriations for the implementation of
capital improvements in the City of Miami for the fiscal year ending
September 30, 1980; and
WHEREAS, Resolution No. 80-612, adopted July 24, 1980 authorized the
City Manager and City Attorney to take the necessary steps to implement a
new Solid Waste Department program for the collection of garbage, trash, and
rubbish within the City of Miami; and
WHEREAS, said program includes a proposal to reinstitute a Citywide
program of residential street sweeping on a regularly scheduled basis; and
WHEREAS, in order to implement said program it will be necessary for
the City to purchase three (3) street sweeping machines; and
WHEREAS, the cost of said machines is estimated to be $129,300; and
WHEREAS, sufficient surplus funds are available from Project I.B.1.,
Solid Waste Operations Facil ity, to provide for the purchase of the (3)
sweepers; and
WHEREAS, funds are available for said purchase from Pollution Control
Bonds and the amount of $129,300 can be transferred from Project I.B.1,
Solid Waste Operations Facility, to establish Project I.C.2, Street
S weepers;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
F LOR I DA :
Section 1. Section 1 of Ordinance No. 9019, adopted November 8, 1979,
as amended, is hereby further amended in the following particulars:
"Section 1. The following appropriations hereby made by
fund and project title include previously authorized
projects and fund appropriations for implementation of all
municipal capital improvements of the City of Miami,
Florida. The sources of revenue to support the herein
appropriations are hereby identified by fund and project:

Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent nr• in con; 1 ict with the provisions of this ordinance are hereby
repealed.
Section 3.
If any section. part

or word of this
ordinance is declared
invalid, the
remaining
provisions of
this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further
ground of the necessity to make the required and necessary payments to its
employees and officers, payment of its contracts, payment of interest and
principal on its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of its rnunici-
pal affairs.

Section5. The requirement of reading this
ordinance on two separate days is hereby dispensed with
by a vote of not less than four -fifths of the members
of the Commission.

Appropriation of $129,300 to
provide funds for three (3)
street sweeping machines
It is recommended that $129,300 be transferred
from Project I. B. 1, Solid Waste Operations
Facility, to Project I. C. 2, Street Sweepers,
within the Pollution Control Bond Fund in the
Capital Improvement Appropriations Ordinance for
the purchase of three (3) street sweeping
machines.
The City Commission adopted Resolution No. 80-612 on July 24, 1980, ap-
proving a new program for the collection of garbage, trash, and rubbish
within the City of Miami. This program includes provisions for street
sweeping.
The above transfer of funds is necessary to provide for the purchase of
three (3) street sweeping machines to enable the Department of Solid Waste
to implement the approved program. Surplus funds are available for this
purpose from the Solid Waste Operations Facility.
The attached proposed ordinance has been prepared for the September 15,
1980 City Commission Meeting. This ordinance was prepared as an emergency
in order to expedite the purchase of the street sweepers.
