A RESOLUTION ACCEPTING THE PLAT ENTITLED
MODEL ESTATES SUBDIVISION NO, 31 A SUB-
DIVISION IN THE CITY OF MIAMI; AND ACCEPT-
ING THE DEDICATIONS SHOWN ON SAID PLAT; AND
AUTHORIZING AND DIRECTING THE CITY MANAGER
AND THE CITY CLERK TO EXECUTE THE PLAT AND
PROVIDING FOR THE RECORDATION OF SAID PLAT
IN THE PUBLIC RECORDS OF DADE COUNTY,
FLORIDA.
WHEREAS, the City Zoning Board and the Department of Public
Works have recommended the acceptance of the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Plat entitled "MODEL ESTATES SUBDIVISION NO. 31;
being a resubdivision of Lots 18 thru 24 inclusive, Block 1, "GABEL
SUBDIVISION NO. 4", according to the plat thereof, as recorded in
Plat Book 16, at Page 23, of the Public Records of Dade County,
Florida, all lying in Section 14, Township 53 South, Range 41 East,
City of Miami, Dade County, Florida, which by reference is made a
part hereof as if fully incorporated herein and the dedications as
shown thereon together with all existing and future planting, trees
and shrubbery on said property, to the perpetual use of the public,
are hereby accepted and confirmed by the City of Miami, Florida.
Section 2. The City Manager and the City Clerk are hereby
authorized and directed to execute the plat.

The Department of Public Works recommends
the approval of the plat by the City Commission
of Miami, Florida, and certifies its correctness
as to form.
The proposed record plat entitled MODEL ESTATES SUBDIVISION
NO. 3 is a replat of Lots 18 thru 24 inclusive, Block 1,
"GABEL SUBDIVISION NO. 4 (16-23) and will consist of 3 Lots
zoned R-3.
Also attached are the following itemized papers necessary to
present the plat to the City Commission of Miami:
(1) Resolution accepting the plat
(2) Print of proposed record plat
(3) Agreement form pertaining to subdivision improvements
(4) Opinion of Title
(5) Memorandum from the Department of Planning pertaining to
landscaping requirements
(6) Memorandum from the Miami -Dade Water and Sewer Authority
pertaining to water mains and appurtenances
(7) Portion of City Atlas Sheet No. 12 showing property platted
colored in red.

REPORT OF PROPOSED RECORD PLAT OF
MODEL ESTATES SUBDIVISION NO.3
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying plat entitled MODEL ESTATES SUBDIVISION
NO. 3 was prepared by Caribbean Land Surveyor, Inc. It is in
correct form for submission to the City Commission and is forwarded
with a recommendation that it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
(1) The property platted is a replat of Lots 18 thru 24 inclusive,
Block 1, GABEL SUBDIVISION NO. 4 (16-23) and will consist of
3 lots zoned R-3.
(2) The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
(3) As certified to by JOSE A. DIAZ, Registered Land Surveyor, this
plat complies with the plat filing laws of the State of Florida.
(4) By authority of Resolution No. ZB 141-79, adopted on July 2,
1979, the plat was recommended for acceptance by the City Zoning
Board of Miami, Florida.
(5) The attached Certificate of Title Examination dated June 17,
1980, signed by Murray A. Greenberg, Attorney, indicates that
the fee simple title to the property platted is correctly vested
in Dade County and the plat has been correctly executed.
(6) The area platted is not encumbered by any mortgages.
(7) In accordance with the requirements of Chapter 54, Section 54-20,
of the Code of the City of Miami, Florida, Dade County has
entered into an Agreement with the City of Miami for the cons-
truction of improvements: landscaping and sanitary sewers.

(8) The location of the property is shown colored in red on
the accompanying copy of a portion of City of Miami,
Florida, Atlas Sheet No. 12.
(9) The attached Resolution has been prepared for the acceptance
of the plat by the City Commission of Miami, Florida.

WHEREAS, DADE COUNTY, a political subdivision of the State of
Florida, (hereinafter referred to as the "Owner"), concurrently with
the delivery of this Agreement, has applied to THE, CITY OF MIAMII,
FLORIDA, (hereinafter referred to as the "City"), for the ncceptance
and confirmation by the Commission of said City, of a certain proposed
plat of a subdivision to be known as MODEL EflTATI,S SUMM/I ;ION N0. 39

plat is attached hereto and made a part hereof as Exhibit "A".

Surveyor certifying that tho Permanent Reference Monuments indicated on
the plat have been inotalled and properly placed.

You requested an opinion of title concerning title to real property located
in Model Estates Subdivision No. 3.
An application for final approval of the plat in accordance with Chapter 28
of the Metropolitan Code is being prepared.
Section 28-3(d) (3) of the Metropolitan Code provides that the application
for final approval must be accompanied by a
"Current opinion of title from an attorney
authorized to practice law in this state."
In compliance with this provision of the Code, I certify that I am an attorney
authorized to practice law in the State of Florida.
Dade County acquired title to the following property through a Quit Claim
Deed dated January 18, 1967, from the Housing Authority of the City of Miami to
Dade County, which deed quit claimed:
"All property, both real and personal, vested
in it or in which it has any interest whether
real or equitable, ..."
Said quit claim deed would include, along with other lands:
Lots 18 through 24 inclusive Block 1, GABEL
SUBDIVISION NO. 4, according to the plat
thereof as recorded in Plat Book 16 at Page
23 of the Public Records of Dade County,
Florida.
I am of the opinion that, subject to the Declaration of Trust between the
Housing Authority of the City of Miami, Florida, and the Public Housing Administration
of the United States, the Declarations of Restrictions, Neighborhood Development
Program Area 9, Model Cities, and subject to any other restrictions, limitations (d�
liens of record, Dade County has title to the above -referenced land located rr ,
Model Estates Subdivision No. 3.

the following trees will be acceptable.
