" g 0- 6 9 3 A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY ZSIGMOND SZABO AND AVA SZABO, WITHOUT THE ADMISSION OF LIABILITY, THE SUM OF $27,000.00 IN CULL AND COMPLETE SETTLEMENT OF ALL CLAIMS AS INDIVIDUALS AND AS HUSBAND AND WIFE, AND ALL CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI OF ALL CLAIMS AND DEMANDS. WHEREAS, ZSIGMOND SZABO and AVA SZABO filed a claim against the City of Hiam.i for ali bodily injury and lost time and wages as individuals and as husband and wife, resulting from an accident that occurred on May 14, 1978, at or near Bayfront Auditorium., in the City of Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's Office, as well as the Police Department for the City of Miami, in accordance with Ordinance No. 8417 which creates the City of Miami Self - Insurance Program, and said Office recoi��'jends this claim b settled for the sum of $27, 000.00; ITEM N0. That the Director of Finance is hereby auth- orized to pay to Zsigmond Szabo and Ava Szabo, without the admission of liability, the sum of $27,000.00 in full and com- plete settlement of all claims and demands against the City of Miami, upon the execution of a release, releasing the City of Miami from all individual claims and/or liens and demands. Knox of Bayfront Auditorium, ttorney Miami, Florida rrnn -v This claim arose from an accident wherein Zsigmond Szabo slipped and fell in a puddle of water located near a first^3 freezer compartment of a catering kitchen located within tl� Bayfront Auditorium, Miami, Florida. ri The ownership and condition of the area has been verified and the responsibility rests with the City of Miami.Cn The function was the yearly International Food Festival. As a result of this accident, Zsigmond Szabo received a torn right medial meniscus. The cause of this particular accident is that City of Miami employees were in process of moving ice into freezer number one from a vehicle located outside the Auditorium. A trail of water was on the floor, which resulted in a slip- pery condition. This build up of water was not removed previous to the slip and fall. At that same time, Mr. Szabo was carrying a container of food for the festival. He came in contact with the water., which caused him to fall to his knees. The claimant was normally employed as a drywall finisher with an average gross income of $480.00 per week with J. M. Drywall Finishers, Inc. To date, there is a verified lost time and wage of some 85 weeks, or $39,840.00. A return to part time work as a touch up finisher on February 18, 1980 has resulted in a decreased income. There has been treatment obtained medically from Melvyn Rech, D.n., as well as several other facilities, in the.amount of $832.98. There will be future surgery required which would result in the removal of the right meniscus. The injury and surgery 8 0-693 � ")._._.-._-..._.... _. elk Honorable Members of the -2- September 2, 1980 required has been verified through an independent medical examination by Melvin Drucker, M.D., an Orthopedic Physician. Medical expenses, excluding hospital, will be approxi- mately $1,345.00, plus approximately $2,000.00 in hospital expenses. There will also be additional lost time and wage in the minimum time frame of six weeks. With a potential total expenditure and loss of $450817.98, this matter has been negotiated directly with the claimant. We find that a compromise amount of $27,000.00 will ex- tinguish this claim in its entirety. This office recommends that the City of Miami pay $27,000.00 in final settlement. The above claim has been fully investigated by the City of Miami Attorney's Office, and in accordance with Ordinance No. 8417 which creates the City of Miami Self -Insurance Program.
