HomeMy WebLinkAboutO-09172LCD/pvg AMENDMENT NO. 33 TO ORDINANCE NO. 9000 9/10/80 ORDINANCE NO. 9172 AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 9000, ADOPTED OCTOBER 17, 1979, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1980, AS AMENDED; BY INCREASING THE APPROPRIATIONS FOR THE ENTER- PRISE FUNDS, ORANGE BOWL AND MARINE STADIUM, BY $40,000 AND $8,000, RESPECTIVELY; BY INCREASING ANTICIPATED REVENUES FOR THE FACILITIES IN THE SAME AMOUNTS; TO PROVIDE FOR PROJECTED DEFICITS IN THEIR PROPERTY MAINTENANCE ACCOUNT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9000 on October 17, 1979, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1980; and WHEREAS, the Department of Stadiums and Marinas reports projected Property Maintenance account deficits in the Orange Bowl in the amount of $60,000 and the Marine Stadium in the amount of $8,000; and WHEREAS, $20,000 of the projected deficit in the Orange Bowl Property Maintenance account will be funded by transfers from within the Orange Bowl operating budget; and WHEREAS, the remaining $40,000 for the Orange Bowl and $8,000 for the Marine Stadium Property Maintenance account projected deficits are to be funded from increased anticipated revenues for the respective facilities; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. Section 1 of Ordinance No. 9000, adopted October 17, 1979, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1980, as amended, is hereby further amended in the following particulars: 1/ "Section 1. The following appropriations are made for the municipal operations of the City of Miami, Florida, for the fiscal year 1979-80 including the payment of principal and interest on all General Obligation Bonds: 17--- 96"ra"s" and76r`-i9gure-s-sfricken"-tlirougW ""sfiaTI-W-deleted; "-Qnaer-scored' words and/or figures constitute the amendment proposed. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. The above appropriations are based on the following sources of revenues for the 1979-80 fiscal year: ENTERPRISE FUNDS - Coconut Grove Exhibition Center $----223;968 248,958±± Marine Stadium ------44;669 52,559 - Orange Bowl Stadium ---};496;;96 1,236,705 TOTAL ENTERPRISE FUNDS* ---4s346;224 4,389,224±± TOTAL OPERATING REVENUES $42602;;W $126,000,547±± ------------------------------------------------------------------------------- ±± Ordinance No. 9109, adopted June 6, 1980, which amended Ordinance No. - 9000, erroneously provided an increased appropriation of $25,000 for the Coconut Grove Exhibition Center Enterprise Fund (CGECEF) from the Municipal Auditorium Enterprise Fund (MAEF) instead of from increased anticipated revenues fro+n the CGECEF. The increase did not affect the total appropriations amount of Ordinance No. 9000. This change is still in effect; however, the herein ordinance restores the $25,000 for the MAEF and reflects the source of the original increased appropriation for the CGECEF as increased anticipated revenue for the facility. -2- 9172 4 Section 2. The herein appropriation increases of $4 0,000 in the Orange Bowl and $8,000 in the Marine Stadium and the corresponding increases in anticipated revenues for the respective facilities are to provide for pro- jected deficits in the Property Maintenance account of each facility. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to make the required necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. The Department of Stadiums and Marinas reports projected deficits of $60,000 and $8,000, respectively, for the Orange Bowl and the Marine Stadium Property Maintenance accounts. Funds in the amount of $40,000 for the Orange Bowl and $8,000 for the I-Iarine Stadium are available from in- creased anticipated revenues for each of the facilities. The balance of $20,000 required for the Orange Bowl Property Maintenance account will be transferred from within the Orange Bowl operating- budget.
