ORDINANCE NO. 9171
AN EMERGENCY ORDINANCE APPROPRIATING $7,9089786
INTO A SPECIAL REVENUE FUND ENTITLED: "FEDERAL
REVENUE SHARING" FOR FISCAL YEAR 1980; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9000 on October
17, 1979, establishing revenues and appropriations for the City of Miami,
Florida, for the fiscal year ending September 30, 1980; and
WHEREAS, said ordinance appropriated an amount of $7,822,490 in
Federal Revenue Sharing funds as General Fund revenue; and -
WHEREAS, Ordinance No. 9101, adopted I.lay 22, 1980, appropriated an
additional $78,450 in anticipated Federal Revenue Sharing funds for the opera-
tion of African Square Park for the period May 8, 1980 to September 3, 1980;
and
WHEREAS, Ordinance No. 9165, adopted September 15, 1980, amends
Ordinance No. 9000, the Annual Appropriations Ordinance for the fiscal year
ending September 30, 1980, to reflect changes that have occurred in the FY '80
budget since adoption of same; and
WHEREAS, said Ordinance No. 9165 increases anticipated Federal
Revenue Sharing funds in the amount of $7,846; and
WHEREAS, under the State and Local Fiscal Assistance Act of 1972
(Public Law 92-512), as amended, a government which receives entitlement funds
is required to establish a separate fund and deposit all entitlement funds in
said fund; and
WHEREAS, in order to satisfy said requirement the aforementioned
amounts of $7,822,490, $78,450 and $7,846, which total $7,908,786, are hereby
appropriated into a Special Revenue Fund entitled: "Federal Revenue Sharing"
for fiscal year 1980;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The resources and appropriations for the following
Special Revenue Fund are hereby established as described herein: 1/
FUND TITLE: Federal Revenue Sharing
RESOURCES: U . S . Department of the Treasury
Office of Revenue Sharing $ 7,908,786
APPROPRIATION: Federal Revenue Sharing -
Fiscal Year 1980

Section 2. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section
3.
If
any section, part of section, paragraph,
clause,
phrase, or word
of
this
ordinance is declared invalid, the remaining
provi-
sions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further ground
of the necessity to make the required and necessary payments to its employees
and officers, payment of its contracts, payment of interest and principal on
its debts, necessary and required purchases of goods and supplies, and to
generally carry on the functions and duties of its municipal affairs.
Section 5. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than four -fifths
of the members of the Commission.

Federal Revenue Sharing - Fiscal
Year 1980 Appropriation of
$7,908,786
It is recommended that $7,908,786 in anticipated
Federal Revenue Sharing funds be appropriated
into a Special Revenue Fund entitled: "Federal
Revenue Sharing" for fiscal year 1980.
Ordinance No. 9000 appropriated $7,822,490 in anticipated Federal
Revenue Sharing funds as General Fund revenue for FY '80; $78,450 in
Federal Revenue Sharing funds was appropriated by Ordinance No. 9101 for
the operation of African Square Park for the period May 8, 1980 to
September 3, 1980. Additionally, Ordinance No. 9165 appropriated $7,846
to reflect changes in the FY '80 budget since its adoption.
In accordance with the State and Local Fiscal Assistance Act of 1972,
(Public Law 92-512) all entitlement funds must be deposited in a
separate fund. The attached proposed ordinance appropriates the above -
mentioned amounts, totaling $7,908,786, into a Special Revenue Fund
entitled: "Federal Revenue Sharing" for fiscal year 1980.
This ordinance has been prepared for the September 25, 1980, City
Commission meeting.
