Since 23 August 1980, we have sent letters through the mail advising the applicants that did not show up to contact the Background Investigation Unit. As of the 04 October 1980 an additional 23 candidates have been In contact with us. This brings the total to 238. Twenty-four (24) candidates have failed to contact us. I.D. As it can be seen as of October 4, 1980 of the total of 365 applicants, only 161 are City residents. As of October 4, 1980 the processing has been going smoothly and outside of the possible problem areas stated in the previous report, we do not anticipate any obstacles to prevent the Department from meeting our hiring goals. 0: Richard L. Arauz , Assistant Director Department of Human Resources September 30, 1980 Police Officer Recruitment Boundaries Yesterday, Judge Kehoe held a hearing concerning the City's motion to expand the recruitment boundaries for Police Officers. Both the City and the attorney for'the Fraternal Order of Police presented their cases before,the Court. Judge Kehoe said that he would look favorably toward granting the City's motion to amend the Consent Decree but, however, he did not have jurisdiction in this case since the Fifth Circuit Court of Appeals in New Orleans has retained juris- diction over the USA vs. City of Miami Consent Decree, in his opinion. The City is I1rcparing a motion to present to the Fifth Circuit Court of Appeals whereby they will ask the Fifth Court to temporarily remand jurisdiction to Judge Kehoe so that he can make a ruling on the City's motion. According to George Knox, this process should take approximately two to three weeks. In the meantime, we will continue recruitment, mostly within the City limits and we will not hold an examination for "out -of -City" applicants until we have a final ruling from the Court.
