HomeMy WebLinkAboutO-09183ORDINANCE NO.r 9 1 8 3 t AN ORDINANCE ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED "HANDICAPPED PROGRAM FEES" IN THE AMOUNT OF $15,000 AND APPROPRIATING THERETO, FOR THE OPERATION OF SAME, REVENUES DERIVED BY PROCEDURE ESTABLISHED BY ORDINANCE NO. 9030, ADOPTED DECEMBER 5, 1979; CONTAIN- ING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO (2) SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the Department of Leisure Services, Handicapped Division has provided and will continue to initiate many specialized instructions and programs; and and WHEREAS, the cost of providing such programs continues to increase; WHEREAS, curtailment of programs and services will be required if additional revenues are not obtained; and WHEREAS, Ordinance No. 9030, adopted December 5, 1979 establishes a formula to be utilized in determining fees and charges for specialized ins- truction and programs offered by the Department of Leisure Services; and WHEREAS, the utilization of a fees and charge system will lead to the continuation of specific programs: After School Recreation Program - $ 5,000 Ceramic Class - $ 11000 Special Events (Field Trips, Concerts, Etc.) - $ 3,000 Very Special Arts Festival - $ 2,000 Sale of Project STAR Publication - $ 4,000 Projected Total - $15,000 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The following Trust and Agency Fund is hereby established and resources are hereby appropriated as described herein:l/ 1/ Underscored words and/or figures constitute the amendment proposed. Oak FUND TITLE: HANDICAPPED PROGRAM FEES RESOURCES: FEES AND CHARGES FOR SPECIALIZED $159000 PROGRAMS AND INSTRUCTION. APPROPRIATION: HANDICAPPED PROGRAM FEES $15,000 Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. An Ordinance Establishing "Handicapped Program Fees" IT IS RECOMMENDED THAT AN ORDINANCE ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED: "HANDICAPPED PROGRAM FEES" IN THE AMOUNT OF $15,000 AND APPRO- PRIATING THERETO, FOR THE OPERATION OF SAME, REVE- NUES DERIVED BY PROCEDURE ESTABLISHED BY ORDINANG NO. 9030 ADOPTED DECEMBER 5, 1.979. This Department recommends that the attached Ordinance be approved to establish a Trust and Agency Fund for the receipt and dispersement of fees for the operation of certain programs provided by the Handicapped Division of the Department of Leisure Services. The programs to which participant fees or charges will be applied are those for which funding is not currently available either through the General Operating Budget or special grants. As per the procedure established by Ordinance No. 9030, adopted December 5, 1979, the total revenues of each program for which a fee or charge is assessed will not exceed the expense required to implement the program.
