AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 8719,
ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANT APPROPRIA-
TIONS ORDINANCE, BY APPROPRIATING INTO THE TRUST AND
AGENCY FUNDS AN AMOUNT OF $334,695 FOR THE OPERATION
OF THE PROGRAM ENTITLED: "RECREATION FOR THE MENTALLY
RETARDED (5th. YEAR)"; COMPOSED OF $304,695 FROM THE
STATE OF FLORIDA WITH A CITY CASH MATCH OF $30,000
FOR THE OPERATION OF THE SAME: CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE: AND DISPENSING
WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPA-
RATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF
THE MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 8719 on
October 26, 1977 establishing resources and appropriations for grant
funds anticipated by the City of Miami, Florida, and for corresponding
City Cash Match requirements; and
WHEREAS, the State of Florida, Department of Health and Rehabili-
tative Services has approved a grant award of $304,695 to the City of
Miami for "Recreation Programs for the Mentally Retarded (5th. Year)";
and
WHEREAS, the above -mentioned State of Florida , Department of
Health and Rehabilitative Services requires that the City contribute
an additional $17,480 in certified public expenditures toward the
"Recreation Programs for the Mentally Retarded", for the period begin-
ning October 1, 1980 and ending September 30, 1981; and
WHEREAS, a total amount of $30,000 has been budgeted in the
Fiscal Year 1980-81 General Fund, Special Programs and Accounts,
Matching Funds for Federal Grants as the City's contribution toward the aforemen-
tioned program and will be available contingent upon adoption of the Fiscal Year
1981 Annual Appropriations Ordinance; and
WHEREAS, this program will serve an unmet need for leisure
services to mentally retarded adults;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 8719, adopted October 26,
1977, as amended,is hereby further amended in the following particulars:l/
"Section 1. The following Trust and Agency Funds are hereby
established and resources are hereby appropriated as des-
cribed herein:

Section 2. All ordinances or parts of ordinances in so far as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 3. If any section, part of section, paragraph, clause, phrase
or word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.
Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.

IT IS RECOMMENDED THAT THE CITY MANAGER BE
AUTHORIZED TO ESTABLISH A_TRUST AND AGENCY
FUND FOR A GRANT FROM THE STATE OF_FLORIDA,
DEPARTMENT OF HEALTH AND REHABILITATIVE
SERVICES AND TO MAKE EXPENDITURES FROM SUCH.
The City Manager has submitted a grant application to the State of
Florida, Department of Health and Rehabilitative Services to pro-
vide recreational programs to mentally retarded persons.
This is a continuation of an existing grant which has been funded
in the amount of $334,695.00 composed of $304,695.00 to be re-
ceived from the State of Florida, Department of Health and Reha-
bilitative Services and $30,000.00 from the City of Miami, match-
ing funds for grants.
Acceptance of these funds will allow us to not only to continue
our existing services but allow us to develop new services to
individuals who are homebound and aged.
It is the recommendation of this Department that this Ordinance
be approved.
