Castano, Director Oct. 30, 1980 City 'Commission Meeting Dept. of Trade & Commerce le elopment As you recall, at the October 9th meeting of the Commission, I presented a legal opinion prepared by•the City's Law Department, after a careful review of the allegations made by Emilio Lopez on the City's funding of SBOC. In that legal opinion the Law Department pointed out two allegations which, if proven, would constitute breach of contract. Those two allegations were: 1) that SBOC has engaged in discriminatory practices by excluding Puerto Ricans from working �n that program, and 2) that Virgilio Perez is a recipient pf an SBOC subcontract while being a member of the Board of Directors of SBOC. Since then, we have met: with SBOC officials and have found these allegations to be untrue. Contrary to the allegation of Puerto Ricans being excluded from the program, we have found that the Program Director, Mr. Prank Estrada, is Puerto Rican. A clerk in that program, presently under CETA is also Puerto Rican. Relative to the second allegation, we are in receipt of a letter from the Board's Secretary, Mr. Pedro Albuerne, who certifies that Mr. Virgilio Perez is not a member of the Board of. Directors of SBOC, nor is he receiving funds under contract with SBOC. Ile is an employee of that Corporation, a fact that does not break our contract with them in any manner. No adverse action against SBOC is justifiable nor,recommended.
