A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE 140, 6871, ARTICLE VI, SECTION
2(3), TO PERMIT CONSTRUCTION OF A TWO-
STORY DUPLEX RESIDENCE ON LOT 3, BLOCK 1;
SUBURBAN VILLAS (24-61), BEING 4617 N.W.
SECOND TERRACE, AS PER PLANS ON FILE, ON
A LOT 3,903,5 SQ,FT, IN AREA (4,000 SQ.FT.
REQUIRED); ZONED R-2 (TWO FAMILY DWFLLING),
WHEREAS, the Miami Zoning Board at its meeting of
September 8, 1980, Item No, 1, following an advertised hearing,
adopted Resolution No, ZB 160-80 by a 4 to 1 vote (2 members
absent) denying variance as hereinafter set forth; and
WHEREAS, the applicant has taken an appeal from the
denial of said variance to the City Commission; and
WHEREAS, the City Commission notwithstanding the denial
of the Zoning Board, and after careful consideration of this matter
finds that due to peculiar circumstances affecting this parcel
of land, practical difficulties and unnecessary hardships would
impair the owner's right to the reasonable use of the property
without the variance granted as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a variance as per Ordinance
No. 6871, Article VI, Seciton 2(3), to permit construction of a
two-story duplex residence on Lot 3, Block 1; SUBURBAN VILLAS
(24-61), being 4617 N.W. Second Terrace, as per plans on file,
on a lot 3,903.5 sq.ft. in area (4,000 sq,ft, required); zoned
R-2 (Two Family Dwelling) is hereby granted,
PASSED AND ADOPTED this30 day of OCTOBER 1980

requested.

following an advertised Hearing, adopted Resolution No. ZB 160-80 by a
4 to 1 vote (2 members absent) DENYING Variance from Ordinance 6871,
ARTICLE VI, Section 2(3), to permit construction of a two-story duplex
residence on Lot 3, Block 1; SUBURBAN VILLAS (24-61), being 4617 N.W. 2nd
Terrace, as per plans on file, on a lot 3,903.5 sq.ft, in area (4,000
sq,ft, required); zoned R-2 (Two Family Dwelling),
One objection received in mail; One objector present at ZB meeting.

A RESOLUTION to provide for this Variance has been prepared by the City
Attorneys ffice and submitted for consideration of the City Commission.
