THIRD STREET, AP2ENDING THE CONDITIONS THERETO AS FOLLOWS: THAT THE NUMBER OF CHILDREN TO BE REGiJLATr!,D BY THE STATE WELFARE BOARD IS NOT TO EXCEED 35 PER LOT SUBJECT TO A 014B YEAR RtVIE4, WHEREAS, the City Commission requested a review of the variance granted at 1523 and 1529 Southwest Third Street; and WHEREAS, some of the solutions Dronosed turned out to be impractical; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF T?IP, CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 37384, which granted nermission at 1523 and 1529 Southwest Third Street .for a variance .for a dnvtime operation only of. a Children's Day Nursery, be and the same is hereby amended as follows: That the number of children to be regulated by the State Welfare Board is not to exceed 35 per lot; subject to a one year review. RECOMMENDATIONS PLANNING DEPT. APPROVAL OF THE INCREASE FROM 20 TO 35 CHILDREN PER LOT. Although the Department's recommendation in 1965 was for denial of the requested variances, the children's nursery does not appear to have adversely affected the neighborhood since it was approved in 1966. The proposed increase in the number of children will not significantly change the facility's impact on the neighborhood since adequate playground area (115 sq.ft. per child) and -screening will be provided, PUBLIC WORKS DEPARTMENT No dedications. D.O.T.T. If there are no traffic related objections from the neighbors the D.O.T.T. has no objection to this proposal. The Miami Zoning Board, at its meeting of September 8, 1980, Item #10, following an advertised Hearing, adopted Resolution No. ZB 170-80 by a 6 to 0 vote (1 member absent), RECOMMENDING APPROVAL of reconsideration of City Commission Resolution No. 37384 which granted a Variance from Ordinance 6671, ARTICLE VIII, Section 3(2)(c), to allow use of Lots 17 and 18, Block 84; LAWRENCE ESTATE LAND CO SUB (2-46), being 1523 and 1529 S.W. 3rd Street, for daytime operation only of a Children's Day Nursery; building on Lot 17 located approxi- mately 2.59' from west lot line and building on Lot 18 being 2,73' from west lot line and 10.75' from south lot line (20' setback required from all lot lines); subject to play area being enclosed with a wall and providing that the number of children to be regulated by the State Welfare Board and not to exceed 20 children per lot (35 children per lot now requested); zoned R-4 (Medium Density Multiple).
