A RESOLUTION PROHIBITING ALL CONTACTS WITH CITY
ELECTIVE OR APPOINTED OFFICERS, OFFICIALS OR
EMPLOYEES BY CABLE TELEVISION INDUSTRY REPRESENTA-
TIVES, LICENSE APPLICANTS OR THEIR AGENTS=
FURTHER REQUIRING THAT THE SUBSTANCE OF ALL SUCH
CONTACTS BE REPORTED IN WRITING TO THE CITY
COMMISSION PRIOR TO THE ISSUANCE OF ANY CABLE
TELEVISION LICENSE] FURTHER PROVIDING THAT THIS
RESOLUTION BE CONSTRUED AND INTERPRETED SO AS
NOT TO CONFLICT WITH THE FLORIDA PUBLIC RECORDS
ACT.
WHEREAS, the City of Miami is presently starting the
process of awarding a cable television license; and
WHEREAS, an analysis of the experience of other cities
which have undertaken this process reveals a pattern of lawsuits
filed against municipalities alleging favoritism and other im-
proper practices by city officials; and
WHEREAS, lobbying 1/ for cable television has been or
may be more intense than the usual, customary lobbying on the
topics before the City Commission; and
WHEREAS, the public good will be advanced if the affili-
ations and activities of these private interests are a matter
of public knowledge;
NOW, THEREFORE, BE IT RESOLVED BY :THE COMISSION OF
THE CITY OF MIAMI, FLORIDA: UO��J1'''�'
Section 1. Lobbying 1� and cotnfitih3bii� ' elective
or appointed officers, officials or employees of the City by
cable industry representatives shall be limited to public sessions.
All other lobbying and communication with individual elective
or appointed officers, officials or employees shall be prohibited,
except that requests by industry representatives, license appli-
cants and their agents for information or for meetings to exchange

"Lobbying" as used herein means any conduct (whether
oral or written) by one who is employed or retained
for compensation, which conduct is intended to act in
some part to influence cable television license issuance.
The term "influence issuance" means to promote, advocate,
or oppose the passage, or defeat, of cable t Cl�evY COMMI$Si�(V
license issuance.

necessary information in the preparation of bid proposals may
be addressed to the City Manager or his designee► as provided
for in Section 2 hereof.
Section 2. The City Manager or his designee can authorize
the exchange of necessary information and meetings with appointed
officials, officers or employees of the City; however, the sub-
stance of any discussions held, information provided, or meetings
attended other than public sessions with cable industry repre-
sentatives, license applicants and their agents shall be dis-
closed in writing by the City Manager to the City Commission
prior to the awarding of the license.
Section 3. This resolution shall not be construed or
interpreted so as to conflict with the provisions of the Florida
Public Records Act (Chapter 119, F,S.).
Section 4. The successful bidder must file an oath
that Sections 1 and 2 of the herein resolution have been adhered
to and that any and all meetings by any of the representatives of
said successful bidder have been publicly held and properly
disclosed.
