RESOLUTION 110. g p - 7 6 0 A RESOLUTION RESCINDING RESOLUTION NO. 79-754 ADOPTED ON NOVEMBER 8, 1979, A.IJTIIORIZI14G THE CITY MANAGER TO PURCHASE IN LIEU OF CONDE,?4NATION TWO PARCELS OF LAND LOCATED AT 2200 NORTHWEST SEVENTH AVENUE, MIAII, FLORIDA, VIA AN INSTALLMENT PURCHASE CONTRACT.; FURTHER AUTHORIZING THE CITY MANAGER TO PURCHASE SAID PROPERTY FOR A SUM OF FOUR HUNDRED AND FORTY THOUSAND ($440,000) DOLLARS 14ITH FUNDS THEREFOR FROM THE UNALLOCATED FY 80-81 CAPITAL IPTPR.OVRP'rETIT FUND. WHEREAS, the property located at 2200 Northwest Seventh Avenue, Miami, Florida (comprised of approximately six acres) is proposed to be acquired for expanded parking and long range planning, for expansion of the Miami Stadium; and WHEREAS, The City Commission by Resolution No. 79-754, adopted November 8, 1979, authorized the City Manager to purchase in lieu of condemnation the above described property via an installment purchase contract for the sum of Five hundred Twenty Four Thousand Eight Hundred Thirty One and Fifty Two One Hundred Dollars ($524,331.52); and WHEREAS, the owner of the property has offered to convey fee simple title to this property to the City of. Miami, Florida, for the re -negotiated price of Four Hundred and Forty Thousand ($440,000) Dollars lump sum payment; and WHEREAS, the necessary monies are available for said acquisition through the FY 80-81 Capital Improvement Program Fftnd; and WHEREAS, it is deemed in the best interest of the City of Miami, Florida, to acquire the property at this time through purchase in lieu of condemnation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF ','IIAMI, FLORIDA- Section 1. TO PURCHASE I14 LIEU OF CONDEMNATION TWh PARCELS OF LAND LOCATED AT 2200 NORTHWEST SEVENTH AVENUE, MIAMI, FLORIDA, FRONTIIIC ON NORTWEST SEVENTH AVENUE BETWEEN NORTHWEST 22 STREET 23 STREET, EXTENDING WESTWARDLY TO NORTHWEST 11 AVENUE, COMPRISED OF APPROXIMATELY 6 ACRES, FOR THE SUM OF FIVE. HUNNDRED WENTY-FOITR THOUSAND EIGHT HUNDRED THIRTY ONE DOLLARS AND FIFTY-TWO CENTS ($524,831.52) SUBJECT TO (a) TERMS AND CONDITIONS CONTAINED IN THE ATTACHED PURCHASE SALE AGREEMENT BETWEEN SEABOARD COAST LINE, RAILWAY COMPANY AND THE CITY OF MIAMI; (b) ALLOCATION OF $118,000.00 FROM THE 1979-80 UNALLOCATED CAPITAL IMPROVEMENT FUNDS TO COVER THE INITIAL DOWN PAYMENT AND OTHER COSTS INCIDENTAI. TO THE ACQUISITION: (c) ALLOCATION OF THE COST OF FUTURE INSTALLIT- NT. PAYMEUTS FROM ENSUINC ANNUAL A.PPROPRIATI0N OF CAPITAL IMPROVEMENT FUNDS, is hereby rescinded, Section 2. The City Manager is hereby authorized to purchase the property located at 220 Northwest Seventh Avenue, Miami, Florida (comprising; of approximately six acres) for the sum of Four hundred and Forty Thousand ($440,000) Dollars. Section 3. The sum of Four Hundred and Forty Thousand ($440,000) Dollars is hereby allocated from the FY 80-81 Unallocated Capital Improvement Funds and other costs incidental to this acquisition. Fos0O8n City Manager In November, 1979, the City Commission authorized the CityManager to - purchase two parcels of land located near the Miami Baseball Stadium from Seaboard Railroad on an installment basis. Since that time we have been unable, working with the Law Department, to detSM%i�e a method for an installment pUrChdS�' which would give comfort to Seaboard Railroad. The Law Department informs me it is not possible for the City to provide a mortgage on proper~for a three-year period. Therefore, l am recommend- ing that we purchase the Seaboard Railroad proper through d single pay- ment from monies available in FY /80-/81 Capital Improvement Program, This will SaV8 the City approximately $80^000 in iOtgy8St COstS^ � 6�� � �~ --------- �----' -'----------7�
