HomeMy WebLinkAboutO-09193ORDINANCE NO. 9 ". 9 `•3 i'o AN ORDINANCE ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED: REHABILITATION LOAN PROGRAM"; APPROPRIATING THERETO AN AMOUNT OF $170,000 FOR EXECUTION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; CON- TAINING A SEVERABILITY PROVISION; AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR - FIFTHS OF THE COMMISSION. WHEREAS, by Resolution No. 80-105 on February 12, 1980, the City Commission authorized and approved the allocation of Federal Community Development Block Grant Funds; and WHEREAS, the City's application to the Department of Housing and Urban Development calls for the City to use Federal Section 312 Rehabilitation Loan Funds as part of its housing strategy; and WHEREAS, such Section 312 Rehabilitation Loan Funds are ob- tained by individual application for each project to the Department of Housing and Urban Development; and WHEREAS, the Department of Housing and Urban Development has set a target allocation for the City of Miami for all Section 312 single family projects in the total sum of $550,000 for the 1980 fiscal year; and WHEREAS, the U.S. Department Housing and Urban Development has presently authorized the sum of $135,000 for the Section 312 Rehabilitation Program; and WHEREAS, the City Commission authorized and approved the allocation of Federal Community Development Block Grant Funds by Resolution No. 78-141 on February 23, 1978 (fourth year) and Resolution No. 79-98 on February 22, 1979 (fifth year) for Housing Rehabilitation of Private Property; and WHEREAS, $10,000 is available from the aforementioned fourth year funds and $25,000 from fifth year funds for the purpose of providing Section 312 rehabilitation assistance loans; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 0 Section 1. The following Trust and Agency Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: 312 Rehabilitation .Loan Program REVENUES: U.S. Department of Housing and Urban Development Section 312 Rehabilitation Loan Program $135,000 Contribution From Fourth and Fifth Year Community Development Block Grant Funds $ 35,000 TOTAL REVENUES $170,000 APPROPRIATION: Section 312 Rehabilitation Loan Program $170,000 Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. City Manager BueJEcT Ordinance Establishing Trust and Agency Fund for the Section 312 ���✓ Rehabilitation Loan Pro ram 9 FRaS4 Dena Spillman, Director F;VFERENSEB Proposed Ordinance: Establish Department of Community Development Trust and Agency Fund for Section sNCLOSUREs 312 Rehabilitation Loan Program , It is recommended that a Trust and Agency Fund be established to receive $170,000 from the Federal Government to finance rehabilitation loans with Section 312 funds and to appropriate these funds for this purpose, per the attached Ordinance. One program of the Department of Housing and Urban Development that Community Development Block Grant recipient communities can compete for funding is rehabilitation loan funds through Section 312 of the Housing Act of 1964 as amended. Rather than allocate specific funds for each eligible community, communities compete for funding of individual rehabilitation projects. Larger communities, such as Miami, are given a target allocation for Section 312 funds. The allocation for the 1980 fiscal year for Miami is $550,000. The allocation for the 1981 fiscal year has not been set. In the Section 312 Rehabilitation Loan Program, the city acts as the Agent for the Feder -al government, locating applicants, processingloans, including all paperwork and disbursing funds according to the loan agreement with the applicant. "-. ^4ty is guided by the specific policies and regulations of the Sectiol, :,iZ ;. ugram in all steps of the process. Section 312 funds are used by the city to supplement the moneys available from the general fund and various grants in funding rehabilitation projects. Since the process is a competition, the city must take positive steps to receive the funds. The Commissi(n has approved the use of Section 312 funds in Resolution 80-105, on February 12 1980 as a part of the 6th Year Community Development Block Grant as one of the •.,)ols for housing assistance. When the housing rehabilitation component of 0-2 Community Development Program was administered by the Dade County Departm�-it of Housing and Urban Development, they applied for and received Secti3i, 312 funds on behalf of the City. Since this function is being administered by r►ty staff, the City is now directly involved in Section 312. Staff has prepared ten assistance applications, which have been approved by the Department of Housing and Urban Development in the amount of $134,600. These funds will enable the recipients to rehabilitate their property while paying only 31% interest. This will be supp emented by nearly $46,000 in CDBG funds. The FY 30 allocation was calculated on the basis of a formula which considered your 1) CD©(i FY 79 Entitlement, 2) The budgeted Rehabilitation amount from your FY 77 and 73 application and your 3) 73 and 79 targeted Section 312 fund. This year such factors as 1) Loan Delinquency 2) Priority for Low and Moderate Income 3) Quality and Efficiency and 4) Distress were not used in the calculation of the allocation because the figures for Florida were incomplete. We expect that this data will be accurate and such adjustments shall be made next year during the calculation of the allocation for the FY 31 funds.
