CHAPTER 54, "STREETS AND SIDEWALKS" OF THE
CODE OF THE CITY OF MIAMI, FLORIDA (1980)0
AS AMENDED, BY PROVIDING FOR THE ELIMINATION
OF ALL DESIGNATED GEOGRAPHICAL DISTRICTS IN
CONSIDERING THE LOCATION FOR PLACEMENT OF
BENCHES AND/OR SHELTER STRUCTURES AT BUS
STOPS WITHIN THE CITY; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE
BE IT ORDAINED BY THE COMMISSION OF THE -CITY OF MIAMI,
FLORIDA:
Section 1. Sections 54-57, 54-57 and 54-60 of Article
III entitled "Bus Benches" of the Code of the City of Miami,
Florida (1980), as amended, are hereby amended in the follow-
ing particulars:'

commercial advertising firms willing to pay
the city for the right to install and maintain
bus benches and/or bus shelter structures in
the public right-of-way in the city, upon
which benches and/or shelter structures
advertising messages can be placed, subject
to applicable rules, regulations, ordinances
and statutes governing the location, installa-
tion and maintenance of said benches and/or
shelter structures.

Sec. 5.1-58. 'Minimum bid.
The minimum bid shall not be les.,L than
twelve dollars ($12.00) per bus bench contain-
ing advertising

'The bid shall be for all existing and/or pro-
spective bus benches of which no more than
eighty (80) percent k eec4i--d4A-Fi#r shall
contain commercial advertising. One-half
of the said benches without commercial
advertising may be used for public service
information pertaining to nonprofit objec-
tives. The decision as to the designation of a
public service bus bench, in the event of a
disagreement, shall rest solely in the discre-
tion of the city manager, whose decision shall
be final.
Sec. 54-60. Agreement required.
The agreement between the city and any
_ commercial advertising firm shall incorporate
the specifications used as the basis for
soliciting bids from commercial advertising
firms. Said agreement shall include the
following provisions, using either "bus ben-
ches" and/or "bus shelters" as applicable:

"Section 1. The CITY OF MIAMI, herein'
referred to as the 'CITY' grants to
hereinafter referred to as the 'COMPANY' the
right to install buy benches and/or bus
shelters approved by the CITY 4rt-GFP1z-
tie."gt ,ftL-4iatrnttat bus stops identified by
the CITY as requiring hus benches and/or
hUS shelters for the convenience of the
traveling public, subject to the provisions
hereof, and further subject to the provisions
of all sections of Article III, 'Bus Benches', of
Chapter 54, 'Streetst and Sidewalks', of the
Code of the City of N•Iiatni, Florida, as well as
the provisions of all applicable state statutes.

as they are inconsistent or*in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions ofthis ordinance shall not be affected.

Bus Benches/Shelters
In anticipation of the issuance of a set of specifications of bus benches and
bus shelters, the attached ordinance is recommended for consideration and approval.
The current bus bench ordinance requires the City to be divided into four geographical
districts for the purpose of designating where bus benches are needed. It is our
Intention of requiring bidders, through the specifications and bidding documents,
to install benches and or shelters at predesignated locations, therefore, eliminating
the need for districts.
