SUBJECT
REFERENCES!
ENCLOSURES:
On Friday, September 26, 1980, the City Commission passed an Ordinance amending
Sections 31-8 and 31-48 of the Code, amending the occupational license clas-
sification and taxes. The subject ordinance was passed on an emergency basis.
It was brought to the attention of this office on Monday, September 29, 1980,
that Florida Statute 205.042 specifically prohibits this ordinance from being
passed in this manner. It specifically requires that at least 15 days public
notice be given between the first and the second reading, such publication to be
in a newspaper of general circulation as defined by law. It is further neces-
sary that we delineate the specific classifications and proposed rates.
Please be advised that we have prepared the necessary lengthy notice to the
public which will be published pursuant to law and have changed the ordinance
passed by the City Commission on September 26th to a First Reading. The second
and final reading of this ordinance will be brought for City Commission action
on October 23, 1980.
