J S$ qo AN EMERGENCY ORDINANCE AMENDING SECTIONS 31-1 AND 31-48 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, EFFECTIVE SEPTEMBER 1, 1980, AS AMENDED, BY REPEALING CODE SEC- TION 31-1 IN ITS ENTIRETY AND SUBSTITUTING A NEW SECTION 31-1 ESTABLISHING THEREIN A NEW OCCUPATIONAL LICENSE - CLASSIFICATION AND TAX FOR THOSE INDIVIDUALS ENGAGED IN THE BUSINESS OF ASTROLOGY, CARD READING, CHARACTER READING, CLAIRVOYANCY, CRYSTAL GAZING, FORTUNE TELLING, GRAPHOLOGY, HYPNOTISM, PALMISTRY, PHRENOLOGY AND SPIRITUALISM AND IMPOSING CERTAIN CONDITIONS UPON THOSE INDIVIDUALS ENGAGING IN CERTAIN OF THOSE BUSINESS ACTIVITIES COVERED BY THE HEREIN NEWLY ESTABLISHED LICENSE TAX; FURTHER PROVIDING FOR AN INCREASE IN OCCUPATIONAL LICENSE TAXES, SUCH INCREASE LIMITED TO 100% INCREASE FOR OCCUPATIONAL LICENSES WHICH ARE $100 OR LESS, 50% FOR OCCUPATIONAL LICENSES WHICH ARE BETWEEN $101 AND $300, AND 25% FOR OCCUPATIONAL LICENSES WHICH ARE MORE THAN $300; FURTHER DELETING FROM SAID CODE SECTION 31-48 THOSE OCCUPATIONAL ACTIVITIES WHICH ARE NO LONGER REGULATED BY THE CITY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City of Miami regulates the issuance of occupa- tional licenses; and WHEREAS, state statutes have in the past limited occupational license taxes to those rates in effect as of October 1, 1971; and WHEREAS, the state of Florida has now authorized as part of the Truth in Millage Act the increase of occupational license taxes, beginning October 1, 1980, up to 100% for occupational license taxes which are $100 or less, 50% for occupational license taxes which are between $101 and $300, and 25% for occupational license taxes which are more than $300; and WHEREAS, the City's cost of regulating occupational activities has more than doubled since October 1, 1971; and WHEREAS, certain occupational activities within the City of Miami which were formerly regulated by the City are no longer regulated by the City and should no longer be listed in the sched- ule of occupational license fees contained in the City Code; and WHEREAS, the business of fortune telling, palmistry, clairvoyance, etc. was formerly prohibited within the City of Miami and has now been found by the courts to be valid business activities but subject to regulation by the City; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: t •— r — � l Section 1. Section 31-1 of the Code of the City of Miami, Florida, effective September 1, 1980, as amended, is hereby amended by the repeal thereof in its entirety '-and the following is substituted in its place and stead: [ CHAPTER 31 ] [ LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS ] [ ARTICLE I. IN GENERAL. ] Above bracketed portion merely indicates proper location for herein substituted material. "Sec. 31-1 Fortune-tellers, palmists, clairvoyants, hypnotists, etc. It shall be unlawful for any person to engage in the business of fortune-teller, card reader, palmist, clairvoyant, hypnotist, spiritualist, phrenologist, crystal gazer, or any other similar business in the city without first having filed an application for a • business license on the prescribed form with the N _ director of finance, which shall include, if appli- cable, the address where the applicant operated such business or a similar business during the past two years, and without first having been photographed and fingerprinted by the police department." Section 2. Where located on private property, each person engaged in the business of outdoor advertising, alone or in connection with any other business, shall be required to purchase a license tag to be attached to each separate advertise- ment on each separate display (except displays advertising a business located on the same premises) in a conspicuous place, and in addition thereto shall be required to have the firm name displayed in a conspicuous place thereon. Where located over, on or above or fastened to any public property (provided that no license tag shall be required for any display attached to the place of business advertised where such display does not extend beyond the sidewalk), a license tag shall be attached to each display and the name of the owner shall be displayed thereon, in the same manner as required where a display is located on private property. For the purpose of assessing a license tax, each such place or structure shall be termed a "display." Each outdoor advertising display shall be at all times made secure in such manner as not to impair the public safety, and where existing outdoor dis- plays are found to be unsafe or dangerous to the public safety, such displays shall either be repaired in conformity with the city building code or removed within ten (10) days after notice by the proper city officials.
