The acquisition and development of the 45 by 50 ft. lot south,of Antonio
Maceo park will cost approximately $140,000.00.
Acquisition of this lot will be extremely difficult because this lot and
the one east of it are opined by the same company - perersosa Bakery. The
owner is opposed to the purchase for the following reasons:
1. it will limit any expansion plans that he might have in the
future.
2. The acquisition of the westward lot would reduce the number
of parking spaces at his other lot due to the necessary change in his
driveway to the parking lot. (See exhibit)
3. The expansion of the park would increase its utilization,
and he feels that the increased usage would have a detrimental effect
on his business.
Due to the fact that we are only acquiring part of this property, the
above three arguments could be used to claim that his property to the
east will be decreased in value as a result of the city's acquisition,
and thereby request an additional payment to compensate for this.
Points that the city must consider before acquiring:
1. The city would have to relinquish use of a 15 ft. wide
strip to permit the Perersosa Bakery access to their parking lot.
Presently, this access is in the northern part of the site. The drive-
way would have to be moved to the southern part to make the park
contiguous. Therefore, even though the city is acquiring 2,250 sq. ft.,
only 1,500 sq. ft. would be usable.
2. Presently, the design of the park points northward,
closing off much of its southern border; unless some redesign is made
of its southern part, increasing the p ark's projected cost, the addi-
tion will not flow with the rest of the design.

3. The space in the new parcel is only sufficient for an
additional shelter (four domino tables) ,
4, This acquisition will be fought in court by the owner
of the Peregsosa fakery, possibly increasing not only the cost of
acquisition, preliminary estimated at 1.7 the assessed value
(31,690 x 1.7 = $44,000) but also the length of time before the park
could be developed, ,
5. If we decided to do a quick take for the property, we
would have to prove in court the need to expand this park, Develop-
ment of this property could take as long as 18 months.
Please inform as to whether or not we should proceed with acquisition.
