HomeMy WebLinkAboutO-09205ORDINANCE NO. n 1) 5 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 6871, COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF LOTS 1 THRU 26 INCLUSIVE; BLOCK 5; BUENA VISTA GARDENS EXT. (4-19), BEING THE BLOCK BOUNDED BY N. W. 58TH AND 60TH STREET AND N.W. 6TH COURT AND 7TH AVENUE, AS FOLLOWS: FROM C-4 (GENERAL COMMERCIAL) FOR LOTS 4 THRU 10 INCLUSIVE, AND C-1 (LOCAL COMMERCIAL) FOR LOTS 1 THRU 3 AND 11 THRU 26 INCLUSIVE, TO C-0 (BOULEVARD COMMERCIAL) DISTRICT, AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDINANCE NO. 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT AND CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DISPENSING WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. WHEREAS, the Miami Zoning Board at its meeting of October 20, 1980, Item No. 11, following an advertised hearing, adopted Resolution No. ZB 203-80 by a 6 to 0 vote ( 1 member absent) RECOMMENDING a change of zoning classification as hereinafter set forth; and THE WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification,as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, The Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of Lots 1 thru 26 inclusive; Block 5; BUENA VISTA GARDENS EXT. (4-19), being the block bounded by N.W. 58th and 60th Streets and N.W 6th Court and 7th Avenue, as follows: from C-4 (General Commercial) for lots 4 thru 10 inclusive; and C-1 (Local Commercial) for lots 1 thru 3 and 11 thru 26 inclusive, to C-0 (Boulevard Commercial) district, and by making the necessary changes in the Zoning district map made a part of said Ordinance No. 6871, by reference and description in Article III, Section 2 thereof. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of necessity to make the required and necessary payments to its employees and officers, pay- ment of its contracts, necessary and required purchase of goods, supplies, and services, and to generally carry on the functions and duties of municipal affairs. Section 5. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
