ING IN THE APPROVAL OF THE SAID PROPOSED r 0 CHARTER AMENDMENT. WHEREAS, a Special Municipal Election was duly held in the City of Miami, Florida, on November 4, 1980; and 14HEREAS said election was duly conducted in accordance with the provisions of the "Electronic Voting Systems Act" (F.S. 101.5601 through 101.5615); and WHEREAS, the official returns of each of 87 election precincts in the herein election of November 4, 1980 have been duly certified by RAI.PH G. ONGIF., City Clerk, Supervisor of Elections for the City of Miami, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The results of the Special Municipal Elec- tion held in the City of Miami, Florida, on November 4, 1980, are as follows: On the proposed Charter Amendment No. 1 which was duly submitted as follows: "Shall subsection 56(I) of the Charter of the City of Miami be amended to provide that the amount of cash payment due a contractor performing a city local improvement construction contract and which payment is retained by the City for up to sixty (60) days after the city's acceptance of the completed city local improvement construction be reduced from ten (1.0%) per cent to two and one-half (2-1/2%) per cent of the estimated contract cost?" there were 29,888 votes cast for the approval the said � CITY COMMISSION "DOCUMENT 14DEX MEETING OF ITEM N0.__ NOV 26 1980 12 r*1 proposed amendment and 22r689 votes cast against the approval of the said proposed amendment, and the City Commission hereby finds, declares, and certifies that the said proposed amend- ment was approved by the electorate; further, the City Commission hereby declares the total number of ballots cast upon said proposed amendment, including absentee ballots, at said election in the 87 voting precincts was 88,999 Section 2, The City Commission also hereby finds, declares and certifies! (a) said Special Municipal Election was duly and properly held and notice thereof was duly given in accord- ance with law! (b) all steps in connection with and leading up to said special election were duly, regularly and lawfully taken and had; and (c) all applicable provisions of the Consti- tution and statutes of the State of Florida, the Dade County Election Code, and the City Code have been duly complied with. Section 3. The City Clerk is hereby authorized and direc- ted to perform any and all incidental duties in connection herewith as required by law. PASSED AND ADOPTED this 26 _day of November, 1980. ONGIE, City fterk of the City of Miami, Florida, do hereby certify that all necessary legal steps in connection with the conduct of a City of Miami Special Election held on November 4, 1980, were followed by the Metropolitan Dade County Elections Department, i.e., Friday, October 31, 1980 9:00 a.m. - Logic and accuracy test of program and equipment which would be used to tabulate the absentee ballots; Friday, October 31, 1980, 1:00 p.m. - Logic and accuracy test of general tabulation program; Tuesday, November 4, 1980, 5:00 p.m. - Precount logic and accuracy test, precinct ballot tabulation, postcount logic and accuracy test; Wednesday, November 5, 1980, 2:00 p.m. - Absentee ballot tabulation. A representative of the City of Miami was present at the logic and ac- curacy tests and precinct ballot tabulation on the night of the election, and during the tabulation of the absentee ballots on Tuesday, November 4, 1980. I further state that all documents concerning these logic and accuracy tests showed the computer to be functioning correctly and are in the possession of the Supervisor of Elections of Metropolitan Dade County, under sealed vault.
