THIS AGREEMENT, made and entered into at Miami, Dade County,_
Florida, this day of
1960, by and between the Miami -Dade Water and Sewer
Authority, an agency and instrumentality of Dade County, its
successors and assigns, hereinafter designated as the
"AUTHORITY", and City of Miami, a municipal corporation of the
State of Florida, County of Dade, hereinafter designated as the
"CITY";
W I T N E S S E T H:
WHEREAS, the CITY owns a certain tract of land in Dade County,
Florida, as described in Exhibit "A", attached hereto and made a
part hereof, hereinafter described as the "CITY'S property", and
WHEREAS, the CITY'S property is located within the sewer
service area of the AUTHORITY and the AUTHORITY desires to allocate
certain available sewage disposal capacity to the CITY, if
available, from in its Central District System, and
WHEREAS, the CITY desires to construct a parking garage over
existing AUTHORITY gravity sewer mains presently located in an
easement on the CITY'S property; and
WHEREAS, said construction will conflict with existing 36-inch
gravity interceptor mains of the AUTHORITY; and
WHEREAS, said gravity interceptors must be removed from
services and replaced by new 36-inch gravity interceptor mains in
the public right-of-way in order for the AUTHORITY to maintain
service to its customers; and
WHEREAS, the CITY agrees to pay for the cost of design and
construction of said new interceptor mains; and
WHEREAS, the AUTHORITY agrees'to vacate the existing easement
on the CITY'S property; and ''

,M EREAS, the AUTHORITY desires to provide sewage disposal
service through its sewage transmission facilities in the vicinity
of the CITY'S property and the CITY is willing to pay all
applicable construction costs and connection charges;
NOW, THEREFORE, in consideration of the mutual covenants
entered into between the parties hereto to be made and performed,
and in consideration of the benefits to accrue to each of the
respective parties, it is covenanted and agreed to as follows:
RELOCATION OF EXISTING FACILITIES
The CITY shall design and construct a 36-inch gravity
interceptor main within the right-of-way of S.E. 2nd Street located
approximately five hundred fifty (550) feet west of S.E. 2nd Avenue
and south in S.E. lst Avenue approximately one hundred thirt,-three
(133) feet. Upon completion of said main the CITY will convey
title to said main to the AUTHORITY in accordance with EXHIBIT "C"
of this agreement.
SECTION II
SEWAGE FACILITIES OVERSIZING BY THE AUTHORITY
All sewage facilities contemplated herein are required to
serve the CITY'S property and no oversizing credits shall be
allowed by the AUTHORITY.

SECTION III
CITY'S COSTS, CAPACITIES
AND PAYMENT SCHEDULE
The CITY shall pay for all engineering and construction cots
as outlined in this Agr.eec;ent except as otherwise noted. In
addition, the
CITY shall pay

charge equal to thirty-six cents ($0.36) per daily rated Callon Ecr
all those units to be constructed within the CITY'S property. The
rating for each type of unit: and/or use is delineat?d in Exhibit
"B" attached hereto and made a part herro(. The CITY intends to
constrict a parkins; ciaraq including twenty thou..^and (20,000)
square feet of office ,passe. Therefore, the agreed total cav,_r,aq
daily gallonage is two thou sand (2,000) gallons, resulting in a
water connection char 1c of f ive hundred sixty dol.lirs (1,,560.00) and
a sewe- connection charcle of :;even hundred twenty ('F'7 0.00) . The
total of one thousand tao hundred eighty dollars ($1,290.00) shall
be remitted to `he AUTHORITY by the CITY %•ri th the execu t ion of this
agreement.

SECTION IV
SEWI.-GE DISPOSAL .3t:RVICF BY THE ALJ'I11Oi2IT1'
The AUTHORITY shall. rocrive, reserve capacity for, and dispose
of, pursuant to the conditio v.s herein, sanitary sowa(3e from the
parking garage and office which the CITY intends to construct
on the CITY'S property, up to the average daily flow limitation of
two, thousand (2,000) qa l l ons p,-�r day.
The AUT1?ORITY w i 11 allow the connection of touch unit
constructed within th^ C!T7 IS property at the time any such
connection is required by tha CI'I'Y, provided that (a) a valid
Operation Permit issued by the State of Florida Depat tment of
